I had four duplicated listings over the past 12 months  that my Ebay software did not catch and my seller status has suffered a down grade do to being unavailable to the buyer.

You're responsible for making sure you don't have duplicate listings. eBay will usually catch them only if they are identical, but the responsibility is yours, not eBay's.
