fraud buyer asking for money or will give negative feedback

I am sick of the fraud and ebay needs to step in and ban these people, i am guessing it has happened before as its a new account with no feedback and claims he got a used item that we had 150 of them listed new in the package as i am a licensed retailer, he even took photo of it in package as proof it was used,   IS EBAY THIS DUMB NOW, he then took pics which showed no wear or use as proof it was used, REALLY?  i already reported but nothing seems to happen, I have started USPS mail fraud claims and i hope they prosecute.  what else to do?

If the buyer files a Returns Request and states Not as Described, you WILL accept the return and pay for a return shipping label.  If you refuse, ebay can refund the buyer from your funds, not require that the buyer return the item, and a defect will be recorded on your account for an unresolved transaction.
