I'm looking to cancel a pre-order on an item. The seller says I have to get ebay to cancel it, so he "won't get points" for cancelling. He also says he won't refund anything until he sells the item again. None of this seems right to me.

The seller is the one to cancel the order, if they want to.
\What is the estimated delivery date that Ebay gave you?
A day after the estimated delivery date Ebay gave you, open an Item Not Received case.
Go to your purchase history and click I didn't get it in the menu next to the item.
The seller will have 3 days to provide a tracking number showing it was delivered or refund.
If they don't, return to the case on day 4 and ask Ebay to step in.
