Buyer has not paid for item but insists it be shipped and has been harassing me by email demanding I shop item.  He was instructed to cancel his order since it was over 90 days so it could be relisted. He won't do anything just demands I ship the item. Again he has not paid for it.

You can cancel the transaction on the fifth day for non-payment.  After thirty days, ebay cancels it, but you now don't get your fees back.  Either way you should then be able to relist the item.  However, you might want to put this buyer on your blocked list before you do.
