My item hasn't arrived

I won an item on an auction and payed for it via paypal the day after and I received a notification from the seller that it was shipped. However, no tracking number was provided. We are both in Europe and 30 days have passed and I still didn't get the item. Delivery status still shows "In transit". To get a refund for an "Item not received" the first step was to contact the seller to let him know which I did.

Now, I want to know how many days have to pass till I can ask ebay to step in? And how long will it take them to resolve it and get a refund if the seller doesn't respond?
