Getting refund

I purchased a fan from eBay and received it. The fan was broken. I contacted the seller to get a refund. The seller asked me to wait until UPS inspects it. He also told me not to contact eBay and guaranteed a refund. However, after he collected a fan without noticing eBay, he is now saying he would not send me a refund tag. I tried to reopen the eBay request but there is no way to open a request and to get a refund. I would say this is totally a fraud.
