Bought an item seller never sent

I bought an item from a seller on E bay On the 9th I contacted him around the 13th about the tracking # no response again I contacted him on the 18 about the tracking # no response well today was the delivery date nothing I contacted E Bay they said I had to wait one more day. I don't understand why. it is pretty obvious it wont be here. so the are Just holding my fund another day Just don't seem right to me.

I mean if your selling something and a buyer don't pay with in a certin amount of days you the seller can cancel the sale if your a buyer and the seller don't sent the Item in a certin amount of day's to freaking Bad son shine you have to wait untill E Bay says you can have you funds back just don't seem fair to me
