2 Unpaid item strikes within 12 mo

Last week I had a non-paying buyer, but this buyer shouldn't have made it past my protection-block for buyers with "2 Unpaid items within 12 mo".  I can tell by the buyer's feedback, many MANY times the buyer didn't pay, and many times the buyer was reported to ebay (according the fb).  Why was the buyer able to bid on my item?

Just because a seller leaves feedback indicating nonpayment (which is a policy violation) doesn’t meant hat they waited and cancelled the transaction as unpaid.  ‘Reported’ doesn’t mean they filed the unpaid cancellation. If they had, the buyer would not have been able to bid if you have the block in place.
