eBay Standard Envelope guidelines state in part that envelopes should be "No larger the 6.125" x 11.5". I have been using 6" x 9" envelopes but also have a lot of envelopes that are 6.5" x 9.5". Could I use the 6.5" even though it's .375" (3/8") over the limit? Does eBay (or the USPS) allow any flexibility in the measurement?

No. That is a hard limit. This is the template for size and aspect ratio for 1st class letters. I have one from the PO that has a slot for checking width and thickness too, very handy. Your larger envelopes would be considered 'flats' as the USPS calls them (large envelopes to the rest of us) and are not machinable.

It is hard enough to pack shipments for ESE without violating the guidelines, and even if you follow the guidelines, you could be caught for non-machineable charges or even jam a sorter.
The Ebay guidelines say you can use toploaders but many sellers have found that if they do, the results are disastrous.

Those are United States Federal USPS regulations, and not eBay regulations.
USPS has become very strict in recent years regarding eBay sellers obeying USPS regulations -- it's probably not worth your time and money risking an "Insufficient Funds" return.
Especially if that "Insufficient Funds" item is mailed to your buyers.
