Why do sellers still have a Top Rated badge on their listings and do not offer free returns?

I thought if we did not offer free returned our Top Rated Badge would not show anymore and I see many Top Rated sellers who DO NOT offer Free Returns and their badges are still there? Seems unfair for those of us complying!!
