What should I do now?

Scam or not? Where do I go from here?  Sold a Lego set (large box).  Buyer pays for it on his credit card and payment does not go through.  He then files an "item not received" with PayPal because he thinks he paid for it.  He puts the payment through again, it goes through PayPal says "ok to ship".  I ship within 24 hours, local California address, he receives it within 48 hours on 3/27.  PayPal reviews the transaction, puts payment on hold.  I give them the tracking number showing it was delivered.  After 10 days, they release the payment to our account.  Here's where it gets tricky.

 

He's got the item for 8 days, and now files with his credit card company as "Item not as described" so the credit card company refunds his payment and charges PayPal, who then refunds his credit card. PayPal then puts the payment from our account back on "hold".  Now he has the product, not returned to us, and PayPal has refunded the credit card company.  Now what?  eBay has never been notified of a problem,  PayPal paid his credit card back, we're left holding the bag?

Payment issues are handed by PayPal so that’s why ebay doesn’t get notified. You have to report the buyer to eBay. The buyer had to have paid the first time otherwise he would NOT have been able to file an INR with PayPal. Payment has to go through in order for there to be a PayPal transaction for the buyer to dispute. Yes you are left holding the bag. You have no seller protection on an SNAD chargeback.

So basically, everything on eBay is free if you're willing to cheat.  We've been selling Lego's for 5 years+ and obviously we know what we are doing, not a lot of brain power needed in Lego sales.

OP~~Just recently I had a buyer do a chargeback through paypal. Paypal covered the chargeback and I didn't lose any money~~I was covered by paypal seller protection.  In the end it was a big mistake as I contacted the buyer and she had forgotten she had purchased the item from me.  She contacted her bank to stop the chargeback.  I don't know what ever happened~~I just know pay pal protected me under their seller protection because I did send it to the address with the paypal payment and I did download tracking.

 

Since your money is "on hold" they may still cover you under seller protection since you gave them the tracking number and if you sent to the address that was included in their paypal payment.  You haven't lost your money yet.

As someone who has sold over 3000lbs of the stuff over the years I can tell you when serious Lego buyers see the word "Legos" (since Legos is not a word, The plural of Lego is Lego) it immediately turns them away.

The first chargeback he filed with PayPal eventually got put back into my account after I sent them the tracking information.  This is the second one that he now claims the Lego (s) were not as described filed with his credit card.  The credit card company gave him his money back and charged PayPal for it.  So now they are holding my payment for review even though he still has not returned the product.

Have you had this happen?  I've been on eBay since 1999 (other accounts) but have never had this one pulled on me.  A return has always gone through eBay and has had to return the item before they get their money back.

You need to understand how dispute and chargeback work.

Dispute of INAD is with Ebay or Paypal,chargeback is with his cc issuer.

Since Paypal holds the merchant account (not you),Paypal is hit with the chargeback,it notifies you a chargeback has been filed,and withhold the payment from your pAYPAL account and submit your tracking etc to his cc issuer.

His cc issuer will review and decide,if you lose,you will lose the payment and chargeback fee of $20,if you want you item,you have to ask the buyer to send it back if he is willing to do so.and you pay return shipping.

Paypal does not tell you any more than INAD,your buyer could have said more than just INAD like this is dirty and you are rude and refuse return,so the cc issuer clerk sat and read all that and decide you lose.

This is a problem selling in cysberspace,accepting credit card payment via Paypal ,selling used items,not being an established retailer and lacking in credibility.

Thanks to everyone for your advice.  I have asked the buyer to send the item back but it seems he lives in Australia although his ship to address is local California and is not responding to eBay emails. Chalk it up to experience, not that big of a loss, just surprising.

Like I said, if you downloaded tracking showing delivery and shipped to the address with the paypal payment you shoud be covered by paypal seller protection.  Don't ask the buyer to ship it back to you~~leave paypal to settle the case.  If you DO have seller protection you aren't going to lose a dime.  By asking the buyer to send it back you are only compromising the outcome of the paypal case.  By asking for the return of the item you can and will lose the chargeback.
