Hi and Good Evening, 

 

      I recently had 5 items listed for sale and sold one of them. The buyer sent the payment immediately. The very next day I sent it out with tracking. a few hours later after sending the item my account was hacked.  Me and the buyer received emails stating that my account had been compromised and that I should change my password. The buyer was prompted not to send payment and if so to contact eBay for further instructions. The buyer contacted eBay and they were told to open a " Item not received dispute" and eBay would close the case in their favor, which is what happened. The buyer was refunded and gets to keep the item. Is this the case?

No, unless you didn't upload tracking into the case showing that the label was delivered.

 

Even though all the details are all over the news, the court still needs to see the tracking number, even though eBay ALREADY has the tracking number.

No, unless you didn't upload tracking into the case showing that the label was delivered.

 

Even though all the details are all over the news, the court still needs to see the tracking number, even though eBay ALREADY has the tracking number.

I don’t understand. eBay screwed up and gave them the money closed case in there favor. It isn’t the buyers fault or seller “My” fault. They closed it even though it showed item shipped. I think eBay screwed up big.

Yes, eBay screwed up ... as noted above, call customer service.  You should get reimbursed.

The info given by the CSR was sort of right as a general response, but the INR should not have been opened until after the estimated delivery time passed.

 

The CSR will receive some "coaching".

 

Hope it works out, but I would not hold my breath.

 

If eBay does not help, and the buyer gets the item you could appeal to their sense of "right", and request payment for the item.

Yes. It almost seems like eBay admitted they messed up and are going to let the buyer keep the item. So weird how they would immediately refund the buyer even though it said item was shipped. I don’t believe eBay can appeal there own decisions. The buyer will just maintain they refuse to do anything as they did only what eBay instructed them to do. **bleep**

As pointed out, you needed to upload the tracking number into the case.

 

Did you do that? If the tracking number is still moving, eBay would've waited.

I uploaded tracking and when they refunded it, it was in transit. They refunded because my account had been compromised.

I am finished selling on eBay.

 

I've done it for over 20 years.

 

Last two items returned as damaged.  Even they are sold AS IS and marked as NO RETURNS.

 

eBay does NOT care about this selling issue.  They refund and automatically withdraw funds.

eBay does not have an "as is" category, and "no returns" only applies to "declared" remorse returns.

There's no such thing as "AS IS" on eBay: You are here and the buyer is there, hence cannot examine the item.

 

Correctly used, when a car is sold "AS IS" at a dealer, you are right there in the parking lot with your mechanic, and you can determine the "AS IS" condition of the car to make your informed decision whether or not to purchase the car.

 

Here on eBay, you tried to avoid taking responsibility by stating "AS IS" on the item, which cannot function when the transaction is not in-person. And when the "AS IS" item is not as described, that trumps your "NO RETURNS" policy ... every time.

Look on the bright side if you can’t Beat them .. Join them

I know of one Seller that turned into a full time Buyer.

He said he purchases items, opens cases, gets his money back and then turns around and lists the item on Amazon.

He said the best part is not having to fret negative feedback.

Ebay seems to immediately rule in the buyer's favor, unjustly IMHO.  They will reverse their decision if you beat on 'em long and hard enough.  That's been my experience in the few cases I have been involved with.

You'd think ebay would catch up with him pretty quickly and ban him from ebay.
