Does a seller have to state if a baseball card is an original or reprint or fake?

A seeler I want to buy a card from says he does not know if the card is real or not, but is not willing to give a refund if it is not.

You may have missed some information when reading about how eBay works.

Sellers aren't allowed to list anything as a reprint or a fake.

You might want to mention that to your seller.

However, if you go ahead and buy it and it does indeed turn out to non-genuine, then you have the eBay Money Back Guarantee for protection. Be sure to read it.

Authorized reprint cards are usually stamped reprint. I found the card and it looks counterfeit to me. The seller has 1 other baseball card for sale that has a book value under $1.00. Doesn't match up with a valuable Ruth card. Also, read eBay's money back guarantee.

As was stated the seller does not have to say basically anything. ON the other hand you don't have to buy anythi8ng. If the seller can't say if this is an original (or a reprint) why do you bother. This will just lead to headaches for you.

The Postage stamp category has a specific category for "Fakes and Reproductions"

The Coin categories have thousands of listings for fakes, reproductions, counterfeits. Nearly 8,000 listings with the word "Reproduction" in the title of the listings. Over 2,000 listings with the word fake in the title. Over 30,000 listings with the word "Fake" in the title under the collectibles category.

The Paper Money category has a section for "Novelty" items.

Over 23,000 listings in Sports cards with the word "Reproduction" in the title.

The Hobby Protection act is pretty specific about what is allowed to be possessed and sold.

Considering the value and rarity of a 1933 Babe Ruth card, $100.00 might be a fair price for a decent uncreased fake.

Only you as the buyer can decide if it's a good deal or not.

If this is the 1983 reprint, a Near Mint #181 Babe Ruth is only worth about $12.00. Sounds like the OP needs to do some DEEP research before committing to a questionable $100.00 replica!
