I have an open case where a seller has a 30 day buyer pays shipping return policy, but refuses to accept a return as they don't want to send a return shipping label for an item not as described. They claim it was as described and I have buyer's remorse. They have asked me to return at my own expense and for Ebay to close the case.
If I escalate the case to Ebay, is it likely I will be provided with a return shipping label? I'm going out of state for a while and am not sure if I should bring the item with me, as I don't want to miss the timeline for returns.

Yes you probably need to take the item with you. ignore the other response asking what good it will do you. Telling the seller you will be out of state is not going to make him send a label faster--he's already refusing to send one! If you ask ebay to step in, they will most likely issue you a prepaid label (assuming the seller is in the US) and you will have only 5 business days to ship the item back. So if you will be gone longer than 5 business days, you'll need to take the item with you OR have someone at home return it for you. You can download the label and email it to that person 🙂

Uh, the OP can sign on to his computer and print out the label no matter where he is as long as there's a printer.

The seller is refusing to send the return label. I haven't mentioned that I'm going out of state.
Maybe I'm misunderstanding - I thought the label just came to me through Ebay and I printed it off on my computer? So it wouldn't matter where I am? Your reply makes it sound like I physically get a label through the mail.

If the item is truely not as described and you're not simply returning it because you don't want it, then yes, escalate the claim with ebay and they will force the seller to send you a return label at their cost. The label will be digital and you can print it yourself.

That responder to appears to be unfamiliar with how ebay returns work. You'll receive a label electronically & print it out. Ebay doesn't snail mail physical labels 🙂

@squallypops Glad to help! The sellers return policy applies to buyers remorse only. When an item is "not as described", you are covered by the money back guarantee so the sellers return policy does not apply to your situation. The seller is required to pay for return shipping 🙂

The seller in this dispute has made all sorts of allegations against me, including claiming I purchased an identical item a day later for less money and was trying to abuse the return processby returning hers for free. She claimed Ebay told her that buying 2 identical items on consecutive days disqualified me from making a NAD claim.
I submitted photographs to the dispute proving the two items weren't identical - both totally different shades of green. I also added both item numbers so it was clear to see that they weren't identical.
Shortly after that, and a matter of hours before I could escalate the case to Ebay, the seller accepted the return. She also sent me a long and horribly abusive email. The email upset me so much that I was left in tears, and so I left negative feedback.
I've just gone to print the postage label, and the seller has escalated the case to Ebay, and I received an email saying they had sent me an email asking for additional information, to be provided by November 1st.
I haven't received any email asking for additional information, so I don't know what I need to provide or where to send it.
I've tried calling ebay customer service, but have gotten different answers from each person I've spoken to, and no-one seems to be able to tell me what the additional information I need to provide is.

Is there some other issue other than different shades of green ? Different shades of a color generally aren't snad

It appears the neg you left the seller disappeared. Was the case ruled in the sellers favor?
