Unbelievable EBay...After researching many post or should I say “ Nightmares “ that you facilitate criminal activities of fraudulent buyers. Just this morning EBay informed me they are siding with a thief who claims thee item I sent was not as described. This after the buyer has refused to be transparent in this matter. This buyer has obviously done this before. So now I’m waiting for thee alleged damaged item to return. However, after reading the hellish experiences on this matter. I have decided to do my own thing. I’m not going to even open up the return package, when I receive it. Instead I’m going to send it directly to EBAY. So they can open it up and not find nothing in that return package. Or, if they do receive an actual item, they can match it to the one I originally posted and sent out. So that they themselves can see that this buyer is a fraud and should be prosecuted to the full extent of the law. Wire fraud is a federal offense. I’d rather do this than play this fraudulent buyers games. The amount of the purchase isn’t that much. It’s the principal that is at stake. The principal that us sellers are being exploited and being taken full advantage of under EBay’s “ Money Back Guaranteed “ policies.
Ebay will find along with the fraudulent package, a letter from me. A letter stating what they are doing to me and everyone else who sells on EBay. I’m an easygoing seller and the thought of a customer doing something like this to me never entered my mind.
I sell sports cards. I sold and sent the purchase order out to the buyer. The buyer said the card came creased. Ok...This is where the crime is committed.
I respectfully asked the buyer to send me two pictures of thee entire card, both front and back. Just like my pictures that I posted to sell the baseball card. What I got was a cropped picture of a card I never seen before in my life. The SINGLE picture only showed the top third front of the card. The fraudulent buyer did this to deceitfully hide the rest of the card. Because two pictures shown of that entire card, both front and back, would not match up with the pictures that I posted. This matter should be completely black and white and a slam dunk. This matter should be of no case. As it is clear as thee light of day....that this buyer is not being transparent and committing thee act of fraud. A criminal offense. EBay can keep that package Im sending them. Because even if there is something in that package coming back to me, which there probably won’t be, it doesn’t belong to me. Because it’s not my card. My card is in that fraudulent buyers collection. A collection with other cards gotten by the buyer. The same way they got my card. For FREE!

Harsh but true. Ebay doesn't think you are honest. The assumption is that you are wrong, you did something wrong, therefore you must pay.
It's an ungly truth but learn from it. List your items they way you would want to see them if you were the buyer. Any defects should have large clear pictures, only facts should be written and everything should be obvious.
That won't help the cheaters and scammers, but it will help with the rest.

Ebay is not going to open that package ot take any sides in the matter whatsoever. They will assume that the package you send them has been tampered with possibly by you. They have no way of knowing what really transpired in this transaction.

When I got my first scam artist on here years and tears ago. I was about as upset as you. Over time, I realized that in order to run a business on here you have to accept the fact that you may get some people on here who abuse the system AND YOU. You factor into your business plan a percentage of loss because of this and you move on. You price some of your other items higher to compensate. Just like every other retail store that experiences shrinkage and theft.

No, if this is what really happened then they are not acting like a two year old they are reacting to a wrong being done to them and crying out for some comfort or help here. Theses boards should be a refuge for people and I totally understand this persons feelings. I wish them the best and hope they can get over this and feel better.

Just read a post about where a seller sold replicated Givenchy shirts, see so no one group is better than the other. eBay wasn’t there when you sold/shipped and wasn’t there when the buyer received/returned. They don’t know who is telling the truth on the outset and you’re up against eBay’s MBG policy for INADs.
Once the case is closed and you’ve received the return back to inspect, you can then gather the evidence to build an appeal case. They won’t let you fight a INAD return that is in progress, and without actually receiving a different card back yet as per return tracking info, you’re just assuming you’ll receive a different card. I know you wanna rant don’t be outraged just yet without evidence.

Yeh and the thief is an upstanding, honorable buyer and decent kind of guy. Yep got it. Next time why not really tell us what you think. After all, I guess we all have to bend over and take it whenever some crook feels he is entitled to steal at will? Thank goodness you're here to show us how petulant we truly are. Thank goodness you're here to offer words of encouragement and to show just important and intelligent you are.

We're presumed guilty until proven innocent here. eBay needs buyers more than they need yet more sellers. Not that that helps in this situation, but better forewarned.
Don't forward the package - it will do no good. eBay is a corporation and corporations don't care. I've had a few fraudulent claims but fortunately, the vast majority of people are good and honest, so try to keep that in mind.

If you have expensive electronic items or anything costly at all, as in watches, phones, jewelry, precious metals, rare antiques, etc., I would advise listing them elsewhere.
eBay these days is like the wild west, except that the bad guys (dishonest buyers, scammers, etc.) have all the guns and the populace (honest sellers) is disarmed. The lawmen (eBay) have new rules favoring the crooks and robbers and they do their best to keep them thieving. Sounds like the leftist paradise where all lawful weapons are banned and only the crooks have the guns.

I'm just dealing with the same thing! Sold an rc truck to someone...gave some b.s excuse that it wasn't as described. It was exactly as described! there was a misunderstanding on his part but he asked for a receiver which I promptly offered to send. He then just said he didn't want the truck. I actually offered that he send it back...but he wanted me to pay for return shipping. I'm not doing that as I did not list it wrong and I even offered to send the part that he thought should have been in there.
Now he opens up a dispute but it's thru his bank and i cannot even defend myself in any way! the only option is to send them one pic that disputes what he says...and eBay will do nothing about this!
How is this fair in any way to a seller?? It's pretty clear that this guy is a scammer and I can't believe that ebay can't (or just won't) do anything about this.
It's very frustrating! I can deal with all the douchebags that just bid on stuff and don't pay...but this is b.s.!

I fully understand your frustration and my words of sympathy may be of little comfort.
In my experience eBay as a platform is not an enemy of sellers.
eBay as a platform does not make laws quite the opposite but they are required to follow trading and consumer rights, distance selling laws made by your and mine elected law makers.
This legislation by your country' and mine's law makers assumes that buyers is always truthful and reality as you and everyone else knows is that this is not always the case.
Any honest buyer would have sent you the photographs before he opened a case and a dishonest buyer will either ignore your request or send you useless photos.
Buyer has claimed that item is not as described and law requires you the seller to accept this return , provide a pre paid return label and issue a full refund including any original postage charges.
I am sure you are aware that on receipt of returned item you should inspect the item and if buyer has made wrong claims or has sent back a different item to what you sold then you must report this to eBay .
If you are a top rated seller then you can seek eBay's advice and refund minimum 50% of the order amount. I can not recall if eBay returns your fees if you do this.
Under current legislation eBay has very limited powers to take action against the buyer other than to mark their internal records and if pattern continues then buyers protection rights ( MBG) are withdrawn first and other actions including removing them from eBay's platform comes later.
Even if your buyer sends you ripped pieces of trash back Law requires you to issue a refund and then make a police report. Problem still exists that Police do not know what you sent and what you received and no doubt your buyer will claim that everything is polar opposite to what you are saying.
I have experienced the same hurt when some one steals from you and there is nothing you can do.
Please do not let this dishonest buyer win twice.
He has or will win 1 by having a refund / stealing from you but don't let him have 2nd win by letting him get under your skin and getting upset.

I used to get pretty worked up about the scammers but ultimately all you can do is block them and let them do it to someone else. I bickered with the last one I knew was scamming and paid for return shipping just to be annoying and they returned it, smashed to bits with a hammer and kept the power supply. Now I avoid having stuff sent back if I can, if it's expensive I'll take whatever junk they send back. We feel your frustrations but there's not much to be done, save your money instead of shipping it to ebay as they will just toss it. Report the buyer and appeal the case they win but in my experience Ebay will always take the sellers word first even if you have pictures of absolutely everything.
