Buyer bought item that was delayed due do the end of year and overseas shipping. buyer started a item not recived case and got fully refunded and then right after that item was delivered. ebay deducted the full refund from my account and buyer is not willing to pay for the item or return the item.
its not possible to have ebay to do anything about this matter, even though the item shows in tracking that is delivered.
it was a higher value item.

buyer just writes that talk to ebay customer service and thats it, he thinks that he doesnt have to pay for the item or return it.
what to do in this situation?

If they wont return it or repay, not much you can do.

Perhaps let the buyer know that you will be filing a theft report with his / her local police department. Then do it.

The buyer did not steal the item. The item was obtained legally.

Usually in this situation I say something like this to the buyer - I'm pleased to see you have now received the item. Sorry about the delay. If you still wish to keep the item I hope you will accept a reduced price by way of an apology.
In the few times this has happened I knock off around 25% and all ended up paying. Maybe I was lucky.

Something must have gone wrong. Tracking needs to be input again when a buyer opens an item not received case. Did you not do that? A buyer gets refunded on an item if it shows "not delivered". If an item has tracking and shows delivered I don't see how buyer gets a refund for a late delivery. Maybe others here can explain that to me.

According to the thread title, the item did not show as delivered when the buyer was refunded.

Call me cynical but I wonder if the item was sitting in customs waiting for fees to be paid and the buyer waited until after getting the refund to retrieve the now "free" item and pay the fees.

Is there some reason you can not appeal the decision?

We don't know the timelines of course how long it was sitting where it was sitting.
Item has tracking...item late in delivery...buyer refunded...item delivered...thus seller is not protected?
