Buyer threatening to open a resolution center case

I sold 2 Galaxy S8's to a buyer and messaged him right after he made the payment that the phones were financed and I will only ship if he is ok with them being financed for first few weeks after which I will pay them off fully. He aggreed and I shipped the phones next day because I was offering same day handling. 

A week has passed and he messages me that he does not like the edge screen and hes not comfortable with the phone's typing and location of finger print sensor, I replied by saying that's the phone, all the galaxy s8's are desined similarly and that he should have known about it. He also told me he was having problems with his T-Mobile Jump account (which I have nothing to do with) and that he would not be able to keep the phones since he cant get out of his TMO jump commitment. Now he's threatening to go to resolution center for a refund by saying that I did not specify that phones were financed in the listing (I told him before I shipped the phones and asked him if hes ok with it, if hes not I can cancel the transaction). He said if you pay it off by July 12 he will be ok with it, its June 25 today and now he gave me 48 hrs to pay it off or he goes to ebay.

 

Now I have never dealt with returns before so I have no idea what to expect and mind you this was a NO RETURNS listing and I asked him if he was ok with that at the time of the sale, to which he responded he's ok with it as long as they are paid off by 12th of July. So my question is what should I do?

Should I accept his return? He says he barely touched the phone but what if he sctrached it or something? I do not think I can charge him a restocking fee since my item was NO RETURNS... Please help me out here, I stand to lose a lot of money if he has damaged the phones and ship them back to me and I cant  do anything about it.

 

IF I decide to accept his return and he sends back the items and they are damaged then what can I do? Can I withhold the refund or charge him some kind of fee or something?

 

HELP!!!

Before you listed such an expensive item on Ebay, you should have researched how returns are handled here. If the buyer wants a refund he will get it. He will open a case with Ebay if you do not tell him to return the phone for a full refund. If you fight the return request and he escalates to Ebay, Ebay will most likely side with the buyer. If he does not get it through Ebay he will file a charge back with Pay Pal. Now, I understand you are afraid you will get a piece of junk back instead of your phone. You tell the buyer that you will accept the return and that you will inspect the return at the P..O. where you hold  all your return  packages for witnessed account of what has come back. This may scare off a scammer. Scammers LOVE LOVE LOVE these expensive phones on here and do all kinds of stuff to get them for free.  Regarding Ebay , mst of the time all these return requests go in the buyers favor. It's the way it works here. Good Luck on getting your phone back.

BTW take off any no returns on your listing. It may prevent some return requests from buyers unaware of Ebay's stance on favoring buyers requests, but it will not work in the long run on here. People who are good buyers want to know they can return something if they simply do not like it or want it. Crooks will have the opportunity to crook you with Pay Pals 180 day return policy.

Now some may disagree with me, however, the phone and/or phones should not have been sold if they were not yours.  Yes, it was in your possession, however, if it/they (because you say, "the phones were financed," you gave the buyer TMI and now he/she is using it to their advantage for a return/refund.

 

I also see that the phone is still for sale?  Am I mistaken and there is no history of any phone and/or phones sold under this id.

 

If this was a sale of a vehicle, and there was still a lien on the vehicle, the lienholder should be paid before the transfer of the title and the vehicle, otherwise, you cannot sell it with a lien balance.  If you can't pay the balance within the 48 hours and the buyer files, you will be forced to accept the return.  And what if the buyer sends you a phone that is a brick, then what?  You would have the brick and still have to pay the balance.  I do not see a good resolution in the future 😞

I think it is a bad idea to sell things you don't fully own.  Sounds like you are robbing Peter to pay Paul.  Not a good practice to start.

What do you mean by witnessed account of what comes back? Should I have some kind of specialist with me when I open the package? Also its 2 phones so I am not scared, I am frightened.

I called ebay and the guy said if he sends back broken or scratched phone, I should call them and they will be able to help me but I did not beleive him because like you said, they side with buyers most of the time.

He also told me to tell the buyer that there is a restocking fee but I am not sure if he will go for that beacuse my listing was no returns accepted and ebay didnot give me a chance to list a restocking fee. Do you have any experience in this area?

Ok I understand your concern but I told the buyer that the phone was financed and that I will pay it off in 3 weeks max. He replied it was ok as long as I paid it off before July 12.

I only sold them before clearing EIP because my ebay promotion for $20 final value fee cap was about to expire. It was a difference of $45 in fees/phone so I decided to take a chance and appeal to human side of these buyers. I told them all upfront about EIP and none of the other sellers had a problem with it and I intend to keep my promise!

I think you meant well, but the buyer is now taking advantage 😞  I see that two (2) buyers have left positive FB for the phones, is one of them the buyer in question?  If so, that may work to your advantage.  You may need a more seasoned responder to help with that.  While I do sell onlne (not here anymore), I am mostly a buyer now and not aware of all the in/out when it comes to a seller winning a  return.  Hopefully one will come along to help out with that.

Nope. Those two are the ones that worked out. I really hope someone can help me out cuz I think this guy is taking me out on a ride and I have no idea how to do this properly.

Hope you enjoyed the phones while you had them because they are likely not coming back.  Well known scam is to claim issues like this with phones, ask for a return and then ship you nothing or a box of junk with a tracking number.  Ebay will only care that the buyer claims to have shipped the phones in the box and once the box arrives and the shipping confirms it has arrived.  Your refund to them is processed whether you actually got the phones or not.  So enjoy, you will be out all of it plus the fees.

Should have really been sure about things before selling something of that price.  Phone scams like this on high end electronics are constant on ebay and have been here for years and years.  We see this sort of thing a number of times a week on the message boards.

Any suggestions on how I should ask for restocking fee and if I should ask for it at all?

 

And what about witnessed account of what comes back? How do I document what the buyer sends back?

I wouldn't dream of asking for a restocking fee.  Nor can you impose one if your buyer opens a NAD dispute.   You just want your items back now. 

 

If your buyer sends you back a rock you are SOL, witness or no witness.
