listed female new west skinscent  fragrance ebays policy took it away. was stated it must be new. im cool with that and i understand. but when you look at other listings and there are over 30 listed and over 20 sold it makes you wonder. i guess people list a half bottle as new and it gets passed . just wondering thanks

Just because others are doing the same, does not make it right or acceptable.  They just haven't been caught...yet.  

 

If you want to continue to sell on Ebay...don't relist it.

Hi @pa-louie 

 

Did your perfume have an 'applicator cap'?  Those are the ones that were once the only used perfumes that were banned.  [I'm not sure if that's still the case.]

If it was removed.  Don't relist it.  If you do, your account can be suspended, and any other account that you have, will have the same result.

Remember the old saying, two wrongs don't make a write.  Ebay has just not caught up to those sellers yet.  It is actually against Health Laws to sell used makeup and fragrances.  

 

Those that are marking them new are simply trying to get around the rules.  If they get caught, they will be sanctioned and they can lose their privilege to sell on this site.

The others simply haven't been flagged for removal, yet! Eventually, ebay will catch up with them. In your case, simply don't relist what was removed already by ebay.

It is frustrating to see others get away with something when yours got flagged. But eBay doesn't catch all the policy violations. It's not fair, but it is what it is, as they say. Avoid using what other sellers are doing as a guide, always go directly to the policy and Help pages to read for yourself what is and isn't allowed. Safer that way. And agree with the other posters, too risky to relist a pulled item. eBay's penalties are cumulative, so a second offense can get you a suspension.

There has been an ongoing discussion for years about whether it's "ebay legal" or not to sell used/open perfumes......this is a quote from a  podcast.....from Griff.........

Griff: Some of the examples in my I collection are really, really old. Like they're from the fifties, forties, even the thirties and some are bottles that are half full from either evaporation or maybe they've been used. Those I cannot list in health and beauty for fragrances categories because they would be considered used. And that category for condition was edited out last year to exclude any used condition.

Brian: Why did we do that?

Griff: Well, it has something to do with the FDA regulations on used cosmetics. You're not supposed to sell them. And unfortunately this makes me furious is that perfumes are considered in there. So eBay was proactive, making sure that they weren't violating FDA guidelines. And so they eliminated the used category from the Health and Beauty fragrances, but there's another category that you can list these in. In collectibles, it's called Vanity Perfume & Shaving Collectibles. That would mean another listing template for that category.
