eBay Updating Marketing Program Terms

Just received the notice in my eBay Messages.  Must read for anyone who use Promoted Listings Standard or Advanced Pay Per click.

I checked the link after I posted, logged out and returned here. Worked for me.  Perhaps it only worked for me - the person who received it?  It's a commonly presented link.

The info about the increase in promo ad fees being based on the total sale was announced in the Spring Seller update I believe, so in looking at today's message from eBay that is confirmed legally I guess.  The part I'm unclear about is the Content section, paragraph 2.  It almost sounds like they reserve the right to change, (it says "reformat") our listing content and gain exclusive ownership rights to it any way they see fit, forever.  Is that something new or had I just missed that for the last several years?  Does this change something for us as sellers?

 

Here's a copy/paste of that section: 

 

"When providing us with Content, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable (through multiple tiers including, without limitation, through eBay’s affiliates, subsidiaries and Partners), transferable right and license to (A) use, reformat, reproduce and display your Ad and Content, including your logo, content, code and material provided by you or on your behalf on the Properties and (B) exercise any and all copyright, trademark, publicity and database rights in the Content, in connection with our provision, expansion, and promotion of our Marketing Services, in any media now known or in the future."

Does anyone know what actually changed? It was hard to tell with all the legal literature they have. Anytime ebay updates I wonder how it works in their favor and how it affects us making less as a seller.

Why don't they just tell us what has changed, instead of requiring everyone to put on their lawyer's hat for an hour to figure it out? You know why. They don't really want people to know. Thanks, eBay, for being so transparent and ethical.

@myhomeschooldelights  I don't think this is really anything new. ebay can now promote PLs on sites like Google, so this permits ebay to take info, images etc from our listings or stores and use it elsewhere to promote our listings. Doesn't bother me at all.

Guess I won't be promoting listings anymore. How is it okay that someone else can change my ad percentage or budget on a whim without my consent or knowledge and I'm legally and financially responsible for it. Also, promoted listing fees used to be by ticket price. They will now include taxes, fees and shipping.

That has been in their user agreement for many years. It is why they do not sell digital items.  Authors and others would not give them their copyrights. But your photos of your item belongs to them and they do pass them along to others.
