Why is eBay allowing the use of other peoples photos?

I'm aware this is allowed. I just found a listing for vacuum tubes that is using my photos.I'd think the buyer would be rather mad to find the tubes they received are not those in the photo. Why does eBay allow sellers to use do this?

The buyer can't pay, I don't know why. I use Westernbid and before saved payment. What should I do? In first time I didn't add email, after I changed the listing, change the shipping cost. Maybe because of this buyer can't pay?
