Ebay fees not making sense?

Ok. I understand ebay final value fees and getting their fee total from the entire anount after tax. What i don't understand is why they deduct the fees from the sold price and not the total value of the sale. It's like they get to have it both ways....

Why do "BUY IT NOW" items remain in active listings even after they've been sold?
