Does Free shipping on items over $50 promotion apply to the list price or list price plus tax?

I currently have a free shipping promotion on orders over $50. Buyer wants to know if the $50 requirement includes the sales tax or just the list price. Item would only be over $50 after sales tax is applied. Thanks!
