This is going to be a long story. I bought a pair of sneakers and after anticipating it may be fake, I attempted to cancel the order 4 minutes after purchase. The seller declined cancelation, ship it 3 days later and said I can return it, once I receive the package. [1st red flag]
Couple days later the tracking# provided by SELLER eventually said delivered to at a mailbox, but my mailbox is too small for a package bigger than a letter. [2nd red flag] Nevertheless, I checked the mailbox, nothing. I assumed they might have delivered it to me, or left it out in front, so I contacted my neighbors and asked family if they seen a package, nothing.
I called USPS the next day, and eventually find out that the SELLER shipped it to the wrong address, completely different from my own, with the same zip code as mines.(The tracking# said delivery of package at my zipcode and city only, no exact address). I contacted the SELLER and state that I never received the package and that it has been delivered to the wrong address, as stated by USPS. SELLER states it was delivered to me. [3rd red flag]
Opened a case of not receiving the item with eBay, stating seller says it was delivered to my address but USPS confirmed otherwise. and that it was addressed to the another address not associated with me at all. eBay closed the case claiming it was delivered to my address based on tracking# the SELLER provided having just my city and zip code. I called eBay and they say that they can see the item was delivered and I need proof the item was delivered to the wrong address to appeal the case.
I called USPS 5 times to ask for proof of delivery for the item, but they say that it was delivered to that (wrong) address the SELLER provided sucessfully, and that there is no documentation that they are able to provide. I attempt to go to my local USPS and ask for documentation of confirmed delivery and they say there is no documentation they can provide and that I should call the same customer service number that I've called 5 times already. They also state that eBay should contact them.
I contact eBay and they say they are not able to contact USPS on my behalf because there is not any documentation, and they are neither the SELLER or me the buyer.
I attempt to retrieve the package at that random location to find out it's a run down house with multiple tenants that don't know where anything is. [Red flag 4]
I believe The SELLER sent me a package with the wrong address on purpose I wont be able to receive it to return it. I think im being scammed and have no way of convincing eBay otherwise. I even went to my local precinct to file a claim and they aren't able to write a report.
Lastly, I contacted Paypal after eBay and they state based on the tracking information and the seller it seems it was delivered successfully to an address with my zip code.
So I lose money cause the package was delivered within a mile and half radius from my home, and not the one that I bought it with through PayPal! This is ridiculous!!!

The seller is lucky that you are not an unscrupulous buyer who would file a "Not As Described" case.

How would it be fraud?
You spent the money. The seller has the money.
You have no item.
It would only be fraud if a buyer, who Actually received an item
sent back .. nothing in a delivery confirmation envelope, for a refund that they were Not due.
And I didn't state a buyer Should send back an empty, nothing.
I simply asked ...
Since the first course of MBG was refused (eBay saying you Got the item)
Could the 2nd step of MBG be acceptable here, or apply under eBay rules? (the NAD)
I didn't advise that anyone should actually do it.
I just wanted to discuss IF any other possibilities existed under the MBG.
I hope everyone reading this, understands the difference.

I understand the difference. I'm not stupid. I am speaking from experience. File NAD when you did not receive the item is fraud and you have to be careful what you suggest here or you will get in trouble. again i speak from experience.
It is only because of what you said that I chose NOT to back up what Lynn said as that would have been my first course of action as well, however I will continue to read this thread and see what comes out of it.
Sadly...
I saw all too late that someone's been gravedigging again...
