So after 48 hrs, I responded to his Case he opened with the expected response. You sell the same unique item I do, and I know the items were brand new when I sold them to you. I know because they were in a package, with scribbles all over, so I decided to remove them and sell them.
So after 48 hrs, I responded to this saying the above. I've heard nothing since. If he doesn't respond back, what happens? He is planning on sending me back the same item, but majorly used with flaws. That's the pics he showed me. Thank you

I'm not sure the buyer has to reply to your message to him, unless I'm not understanding the events as they stand so far . . .

Based on the feedback I am guessing this involves the Whitman cards? Tough one but as long as you have been on eBay if this is the first time you have had to deal with a return situation consider yourself lucky in that respect, especially since it is not an expensive item.
MBG puts you in a bad spot with only a couple of options available neither of them in your favor but you need to officially respond to the case within the time limits or you can be sure the buyer will immediately ask eBay to step in and you will automatically loose and the buyer will retain the item.

Thank you. April 23rd I offered them $1. So far, no reply. I suspect the Cop already went out to visit him, he's a seller so he's surely online. I know he is confident I will file a police report for theft. He may have backed off now how to get that nonsense removed from my feedback. It's untrue.

Yes it involves the same whitman cards he has for sale, but his are a hundred something dollars and mine were $35. He is clearly buying it to re-sell it but wants to send me back damaged cards. He even snidely said "I will force Ebay to return" as if he's done this 100x before.
I am on a mission. This guy will regret trying to scam for such a little amount as $35. He may already be gettign clues to back off, we'll see. EBAY asked him to return so not sure how long he has to do it, it didn't say on that link.

The Cops say they went out, of course I cannot know for sure. But the buyer is being awfully quiet. He's a seller so is not responding right now to my $1 offer though it also said Ebay told him to return it. I almost want him to return items I never sent, he really needs to see what happens when he thieves from people.
This cop spent time at it. He saw all the messages, he's also sold on ebay. He understands what is happening

Buyer is a seller of the exact unique item. He said I mailed him used items then took pics of a different item, not mine sent him, to show it' was wore out.
I responded to the buyers request offering $1. Yet it also says Ebay told him to return the item. He needs to bow out now

This is not the city, there isn't much to do in small towns. Also they often know if the thief has a criminal background too. I love small towns, would never live anywhere else

Apparently you are upset that a buyer has opened a INAD case. The only action you can take here is to pay for return shipping and wait for the item's return and issue a full refund.
This is not to say that you will 100% receive the same item back. That is the chance anyone here takes when they sell something - as hard as that may be to believe, it's just the way it is.
Offering a $1 refund, calling the police, accusing the buyer of being an unscrupulous reseller by selling what you sold him for far more money than you charged (reseller resell - it's what they do) - none of these things matter in the grand scheme of things.
It appears that you have had good success with sales and lovely feedback. I'm not sure I know of one seller that hasn't had to deal with returns and disappointments. Sometimes it's just a case of letting go and moving on.

Looks like all replies are gone. With that said there is nothing you can do until after you know for sure the buyer is a thief as you have not even received the item back yet.

In all my years selling online that's the first time I ever saw someone threaten to let the City Council loose on someone...and the buyer's own city council even.
