Listed a children's classic book which apparently now is considered offensive and discriminative so it was removed by epay. Since I've seen this very book sold on the site numerous times I did the quick results search and yes, these very same letters were sold 6 times in the past 30 days. Even ATM there is an active listing with the same book that's been waiting for the auction end for several days.
When I contacted the fees collectors the rep only could tell me that that was a restricted listing according to their policy. All my attempts to find out how come other sellers were/are allowed to sell it were in vain.
And yes, the seller who is selling it freely has more than 24,000 feedbacks.
Talking about discriminative...

The other sellers haven't been reported to ebay yet, that is the reason why they are still selling the book.

The rights owner has classified some books as offensive and eBay has gone along with them on the subject..
Any with the tiles if reported will be pulled.
Some others Authors titles are classified as offensive also....
Be nice if Ebay had a list of all the authors and titles of such they consider offensive.....but I will not hold me breath waiting for such...

Just a couple of references in your post I didn't understand:
As far as whatever book you're trying to list is concerned, it's apparent eBay will not allow you to list it. It's one book, for goodness' sake. Sell it elsewhere.

how true; but my point is that the ebay is clearly aware of the same listing being active and for some reason they don't remove it or do anything about it; i wonder WHY? what I should've done to be let alone too?

Not all violations get caught at the same time, at the same rate. Ebay is not always timely or consistent when enforcing the rules. Unfortunately you were snagged. Ultimately it doesn't matter what other sellers are doing. Your account is the only concern.
Whatever you do, don’t try to relist the item in question. Doing so can compromise your selling privileges.

It's clear you have an agenda here, but it isn't clear what it is. What is it you're trying to get at?

Now you're asking members how to help you avoid getting caught violating eBay policies on listing prohibited items? I don't imagine you're going to get too many responses on that subject. It's not only against the Community guidelines, but also just a bad idea. Most of the participants in the Community prefer to follow eBay's policies, not help others get around them.

not sure why you are suggesting things i never asked for, i.e. "how to help you avoid getting caught violating eBay policies on listing prohibited items"; i asked a very simple question, why was my listing removed and why a listing with the same item is still active even though we discussed this with the ebay rep 10 hours ago? how is that "against community guidelines" ?

I understand epay and fees collectors, but only because I spent some time in the hollers of Tennessee. Then again I'm not sure why the cheerleaders are acting ignorant either, it's pretty simple to understand and why are some folks allowed to use lingo while others can't, just because the newcomer isn't using proper lingo?
So here on the forum it is acceptable and understood what "cheerleaders" mean, but somehow fees collectors is improper, let me just say they're not the same thing, cheerleaders here are the folks who stand up for eaby in the face of all naysayers.
So...
The OP is simply using the word epay as some might use the word feebay, meaning it's all about money anyhow... And the fees collectors in this case is the CS, the fees collectors are the people in charge of collecting that money... I will say however, the CS doesn't actually collect the money so they're not the revenuers the OP so fears.
Hopefully that clears things up a bit.

If it was removed by ebay. DON'T RE-POST. You will get your account suspended. Its not worth the hustle, getting angry or wasting your time to talk to ebay reps about the issue. Look for other places to sell the book, if you are still wanting to sell it.
