Received notice of unauthorized payment after 1 month after buyer received item from me.

I have a buyer who claimed his purchase was unauthorized and made a claim through his bank even though he received the item a month ago and I have tracking to prove it. No response from him when it was received to say " I got this package from you that I didn't order, should I ship it back to you?" Nothing nudda, just a shock of a claim going through 2 days ago. Will he be allowed to keep my product and get the refund as well?

Delivery is not necessary to win an unauthorized claim charge. All they require is proof that the item was shipped to the payment address.

Isn't that pretty much the same thing?  If tracking shows the item was delivered, that means it was shipped.  And if it shows the item was delivered to the address on the PayPal payment, that means the item was shipped to the payment address.   That seems like proof to me.

It is important to remember that the ship to address on the PP payment does NOT have to be the same as the payment address or the address that is associated with the CC used.

Any of us can have multiple ship to addresses on our PP account if we want to.  I use to have things shipped to my daughter when she was away to college on occasion.  So the ship to address may or may not be the same as the address associated with the CC that was used.

Thank you for clarifying this, I have provided proof of shipment and delivery since the tracking provides that. Thank goodness both the PayPal and Ebay addresses match and that is where I sent the package. PayPal has released the funds to me, but have said the investigation could take 75 days. I believe and I could be wrong that the bank has already released the funds to the buyer. I hope not because this could easily be some scam. How does someone other than the buyer get his password and order stuff and the buyer receives it without questioning it? I have still not heard a single word from the buyer concerning this matter, even though he would now have my information. I had even given him positive feedback.

That is terrific news.  The 75 day thing is a normal thing for PP to state, so try not to worry about it.

As for your buyer, It isn't likely that they CCC has done anything yet because things are still under investigation.  When you place a charge on your CC in dispute, it just goes into a limbo state.  The card holder doesn't have to make a payment towards that amount in dispute while in the limbo state.  But if the CCC determines that there wasn't an issue with the purchase, the amount would then be placed back on their card due and payable plus interest for the time it was in limbo.  At least this has been my experience.

No it’s not the same thing.  Yes if it was delivered it was shipped but it being shipped doesn’t mean it was delivered.   A seller only needs proof it was shipped they don’t need proof it was delivered

Now you have me really confused.  lol

It's just that you can ship something that may not get there and so it will never be delivered.  If it was delivered, we know it was shipped.  While an Ebay claim needs tracking proving delivery, a Paypal claim just needs proof of shipment, and that is the difference.

My apologies.  That's Ebay's requirement, not Paypal's.

My fault.  I wrote proof of delivery, which is Ebay's requirement for an INR.  For unauthorized charge, Paypal's requirement is just proof of shipment.  My apologies!

Only if you don't respond.

Upload the tracking in paypal. Screen shot the item details page and upload that too.

BBL you buyer and you are done.

Good luck. I am dealing with a similar issue with PayPal. They consider the bank inquiry external and have little power over that issue. I did everything right....sent the package with tracking too. Same lack of response from buyer. PayPal has already ruled in favor of the buyer and the buyer’s bank, so I am appealing it. I have suspended selling on EBay because of this unauthorized claim scam ( the second one I’ve dealt with in a short time). Too many people are trying it and sellers are losing.

Maybe try approaching this problem with PP stating you met the requirements for Seller Protection on PP [if you did].  Did you ship to the address on the PP payment?  Did you ship within a week of payment?

Also check your addresses on the PP payment and on the Ebay purchase.  If the addresses are the same, then either your buyer had their Ebay account hacked too or they aren't being forthcoming.  Or they have someone in their household that is using their CC without their permission, which isn't likely to stand up as a reason.

Look at all your details in Ebay and PP.  Then call and talk with PP.  The mere fact that a buyer files an unauthorized CC claim does not mean they win.  And all sellers pay PP a fee which includes Seller Protection if you follow the rules.

Why aren't the banks and PayPal catching on to this scam? Sellers will stop using Ebay's services if people can get away with doing this, especially if it's obvious the item was delivered to the correct address and the buyer still wins.

Because they all aren't scams.  Sometimes it is true.  But the OP has left out some details regarding questions that have been asked here, so we don't have all the info and it is hard to tell if the buyer is mistaken, wrong or a scammer at this point.

The Blocked Bidder List:

https://offer.ebay.com/ws/eBayISAPI.dll?BidderBlockLogin

Add the problem buyer's ID to your list there, and he will be blocked from using that ID for future bids or purchases from you.

Note that it has no effect on your current issue; you still need to provide proof of shipping as part of your defense against the Unauthorized Payment dispute.

I'm going through the same issue right now the buyer reported unauthorized after 3 months. It's becoming pretty clear that eBay will definitely side with the buyer every time because that's where they get the money from. They have tons of other sellers they do not care. I guess the only thing to do is move to selling to a different platform like macari.

You should start your own thread. If it's only been 3 months, you still have tracking showing delivered. So upload that tracking number into PayPal (it's not an eBay case) as your Proof of Delivery, and get your money back.
