So I shipped a bare root tree priority mail on the 28th of April. As of today tracking shows it’s not even out for delivery. If it arrives it will probably be dead. So what’s fair about me having to eat the refund? And yes it was packed properly.

Because you chose the shipping service and you're responsible for the item until it gets delivered in the condition you stated in your description.

EBAY holds seller responsible if item is damaged or lost in the mail. Seller is then supposed to file a claim with USPS. Of course, USPS rarely pays for broken items and doubt they would ever pay for a dead plant.

I would think that is what they meant.
No different than holding the LA Times responsible for someone that buys your car with a bad check; or someone that never shows up and you took off work to meet said buyer or or or.....
This site is nothing but a 'todays' newspaper ad.
You list, you picture, you are responsible to guarantee your item (condition as stated/pictured) and its delivery (on time).

This is between you and the carrier and carriers won't pay out on this type of claim unless the box is run over by a truck or something to that extreme.
If it arrives dead you are responsible for refunding the buyer.

Doesn't PM have insurance already? Seems to me your issue is with USPS as carrier, eBay was just the platform to unite seller/buyer to interact.

Sellers take a chance with shipping of such items as that.
There can be delays..just like delays at Newark Airport in New Jersey.
We wish everything ran smoothly...but alas, it doesn't always.
I notice someone selling chick eggs on eBay or live fish.
I can't even imagine...no pun intended..but what if the egg was a chick when you got it or you bought 5 fish and only one fat fish was in the container?

Yes, but the terms say they won't cover this type of situation for this type of product.
If plant died because their truck ran over it and tore it apart (not due to faulty packing), that they should cover (would take at least one appeal as every claim does these days).
But dead plant because it was in transit too long is not covered.

That happens more often than you might think if the eggs are fertilized and kept warm enough... and the USPS does permit shipping live chicks as well. On multiple occasions I've been in our local PO when they have a shipment of live chicks awaiting pickup. Hard to miss all that loud non-stop cheeping...

Kudos for thinking ahead, but maybe eBay won't have to be "unfair" to you because you don't even know yet if the tree really will be dead, or if the buyer will file a return. No need to get disgruntled about something that hasn't happened yet.

Don't jump the gun and assume it will arrive dead. You said you packed it properly. As long as the roots don't dry out it might start to bud out but as long as your buyer gets it planted right away. Hopefully you provided instructions as to planting to your buyer.
No it's not fair if you have to refund but it is what it is.
I've planted quite a few trees bareroot and every one of them have grown into beautiful trees as long as the roots were not dried up and I planted them right away.
Hopefully your buyer will treat them well and all will be well.
