I need some guidance here as my son has started to customize various pairs of Nike’s by swapping out the swoosh, adding embellishments, or mixing brands. I can search eBay and find 14,282 current listings for “Customized Nikes, Customized Dunks, Custom Yeezy, Custom Jordon, Custom Anything”.
I have posting and sold a few pairs but only after eBay’s algorithm remove the posting for counterfeit policy and I had to call eBay and have them review the post and they relisted the shoes. However, I don’t want to be having to call eBay every time I post a pair of customize shoes because their algorithm marks it as counterfeit.
Where am I going wrong in my listing as a market customized. And I also market as handmade. I list out the model in the description that the shoe is based off of.
Any guidance from expert sellers who do customize shoes would be so greatly appreciated as I can’t spend our time calling eBay, and having them of you every post that we want to do.

“The second link to to the "Blue Lobsters" which is impossible in Nike By You. That isn't a valid answer.”
Hi @owners-nowtrendingshop I think you are focused on and arguing the wrong point.
The issue of importance here is not what other sellers are doing, and how they are doing it.
The only matter that counts is that eBay took down your listing(s). That places your account and actions under heightened scrutiny.
Removal of listings needs to be taken seriously. It carries the potential for permanent suspension of selling privileges if subsequent infractions continue.
As a general practice, it is not a good idea to base one’s listing decisions on what others are doing. Only eBay’s official position is valid.

You can’t sell them here if they were taken down once they will be taken down again. if that happens your selling account will be in jeopardy.
Sorry.
ETA: Just because you see hundreds of other similar listings it only means they haven’t been reported or taken down yet.

Copyright laws forbid you to take the 'well known' part of someone iconic emblem and put it on any other shoe.
Your takedowns were legit.
Your 'selling' illegal shoes.
Like stated, a CSR may tell you one thing, but you are on the radar for life- do NOT relist ANYTHING like that again.
ps. there may be 1000's of 'others' doing the same, and they are ALL infringing and will also eventually get caught. But, there are MILLIONS of things like this listed so this site has no way to 'constantly' be removing items- they basically play 'wack-a-mole'.

But if they remove a logo from a shoe, and put other decorations on that shoe, then they can still legally sell ihat shoe as that brand, explaining that it has been customized.

I have a hard time believing this as they wack me within minutes yet there are “trusted sellers and entire stores selling customized shoes with logos all over them.” They even have eBay’s trusted seller logos and have built entire eBay shops around it
The Shoe Surgeon
Custom Kickz
ShoeSupply
Years of selling and eBay reviews. All branded items

Why is OOAK allowed?
Customization of dolls is allowed, and the makers have been around far longer than famous shoemakers. I believe there are OOAK in die-cast and other items.
Where is the line drawn for OOAK?
(OOAK=one of a kind) 😾

What I noticed was the swoosh was not removed from the listings I looked at. The artwork was added to the shoe, to the swoosh, etc. Maybe it isn't allowed to modify the actual shoe components, but you can paint all over it.

I am going to talk to eBay again tomorrow and then probably give up on custom shoes. Thanks everyone

If you put their label, logo, trademark or badge on another companies product or on an item you made, that is what the issue was.

Then please people explain how these sales and posts are happening.
And you can’t say “they will eventually be banned because they have sold 100’s of shoes and they are faking real shoes.

I only looked at the first two links, those are Nike shoes bought from Nike using Nike's "customized shoe" program.

Because the swoosh is still there, the original design, logo, etc., is still where it was originally put on the shoe.
You can color the shoe all you want, but you can't take the logos off, move them around, or add another brand's logo on it.
Original artwork on the original shoes.
