Possible Harassment

I have been selling replacement parts for toys that are out of production by a company that is defunct. It's been fine until recently,  all my post are being flaged as counter fit or "search manipulation". I clearly state these are not orginals and even have my brand on them. Simular to an aftermarket mirror for your car I mentioned what they are for. This only recently started happening after getting into an argument with a follower on my Instagram that felt I was "price gouging " on a one specific item. Granted it's priced higher then the other simular peices but it's also 10x rarer and the orginal can go fit 5x as much is not more. One of  "cheaper" one really cost me nearly the same but make nothing off them.  So my question is. Is there a way to inform EBAY that the flaging is possibly being done by some one who has a grudge? Also is there any other guidance on how I should word my  listings?   Here is the description of one of the listings.  

REPLACEMENT Dino Damage (1 piece) for Jurassic Park Series 1 Young Rex. These are not orginal they are 3D printed with flexable resin that has been dyed to match the orginal as close as possible, but due to fading of the orginals a perfect match is not guaranteed. This resin is flexible but is not as soft as the orginal. These are marked with my logo so as not to be passed off as orginals.

The  "Brand:  Jurassic World"  would definitely trigger it.

Thank you this is very helpful. I guess I'll reword everything for the 5th time this week. Lol. All cause some guy thought $40 was too much for replacement part that the orginal goes for $200 plus, and that's if it ever even goes up for sale again. I don't believe anyone has intentionally sold one in 2 years. One or 2 have popped up in lots from people that didn't really know what they have,  but that's about it.

Yes you can.  There's plenty of legal prescient if you are only selling "parts" and not copies of the entire Copyrighted/patented items. More are you "brandng" them as orginal. Legally speaking you can. If not NAPA, Autozone,  advance autoparts wouldn't exist. The only thing that is tricky is using the Copyrighted Name, and you can use it in adverts, just depends how. IE. "Ford F150 mirror" is bad. "Mirror that fits F150" fine. As long as it's not a patent infringement. And as these patents expired atleast 7 years ago they are not protected. I did plenty of research before doing this. One thing I didn't account for was specific "buzz" words setting off AI when some one starts maliciously flaging listings.

There was a guy on here that used to sell "replacement bricks" for lego sets, but never used the word "lego", but the dimensions, etc.

However, after several take downs and back and forth, e-Bay ended his selling privileges on a permanent basis.  No discussion, no hoopla, just done.

While you may be within your "rights", you have a huge target on you and your listings right now.  Not saying that is fair, but if you get many more of these, you too will be done selling here.

What I would do is work to engage a higher level of e-Bay and ask how best to work to color inside the lines and make these work, IF that is even possible.  I would not "guess" or revise or do anything until I knew for certain that what I was listing was not going to draw more "issues".

OR - you can do it your way (you did post here asking for help, but yet seem resistant to listening to any of the posters trying to assist you) and end up like replacement brick guy.

Reach out here.  There is a message button in the upper right.

Message them, but NOT about your violations or if you are right and e-Bay is wrong.

Message them about your "products" and outline/detail your dilemma and seek guidance.  Advise you value your Seller account and ability to sell here and provide a viable replacement alternative for OOP items, etc.  

If you message them pounding about how "wrong" this is, you will not get far.

Good luck and I sincerely hope you find a solution.  Dial it back before you message them.  Include your Selling ID and an email/phone number to contact you back.

I'm not resistant to help.  But blanket "you can't" statements  don't help when there's plenty of other sell after market parts for a verity of things. I've been taking others advice and rewording my posts bases of another's post. And you post has probably the most helpful  seconded to the one quoting the actual "after market" policy. Your link for the most part what I was looking for as I've haven't been able to talk to a real person.

Post a message to them - they are dedicated CS to Sellers.  

But sincerely focus on how best to fit into the constraints of the site and not on whether this is right or wrong.  

I think if you do, they will help you work towards a solution.
