Listing says the item it ships from the US.
Item ships from China.
Not as described? Would a buyer win a not as described case?

You can report the item for item location misrepresentation but you wouldn't win an INAD.

...my post got messed up and I didn't get to finish it.
Nothing in here says anything about refunding buyers.
It seems like more of an administrative slap on the wrist rather than a hard penalty type situation.

Any buyer can lie. With that said if you get it and it is OK the question is "why" would you want to file NAD case ? If it is late that is a different story and you can file an INR case.

You might want to ask the question on Weekly Chat next week. My guess is the same as coolections: I believe an ITEM not as described means just that---the item itself is not as described. Not sure that the item's ship from location has anything to do with the description of the item. On the other hand, if ebay has figured the estimated delivery time based on a US location, and it takes too long to arrive (because it is coming from China), you might have an INR claim.

Any item can be 'not as described' and all filed returns for refunds will be honored regardless of the 'true' reason.
