Yes, it demonstrates once again how poor the "automation or artificial intelligence" is, as a result of which some listings that are in total compliance with every eBay policy get yanked and the sellers are sanctioned, while other listings that are flagrantly and shockingly wrong remain untouched and the sellers allowed to carry on.
The only listings I ever reported were those in clear violation of the eBay policy, which is itself based on the Indian Arts & Crafts Act of 1990 -- and not a single one of them was ever pulled by eBay, so I stopped wasting my time.

At least it sounds like this person is just making a fool of themselves rather than passing off misattributed and fake merchandise.

True, and among a billion and a half listings, few will ever even see it. But the fact that it's up, and that even when it's reported it remains up, is another example of the poor state of "automation or artificial intelligence." Of course, it will get better over time, but in these early days it is alternately laughable and frustrating to deal with.
