INFRINGEMENT LIST

Is there an. infringement list of Brands that are not allowed to be sold on Ebay? If so I would like to know where I can view it.

Example: I once listed a Red Ryder Wagon still in the box that needed assembly and I was told that this was an infringement and it was removed because of Red Ryder being stated in the listing. I was kind of confused but you know I didn't question it of course.

There is a VeRO list, but it does not contain all VeRO products, the only thing you need to know is when a listing is removed under VeRO - you don't relist it.

This is interesting 🤔 I have had issues with luxury brands that were not authentic being pulled, for the record  I was not selling it as authentic, you could tell by obvious reasons such as the price. But you live and learn. Sent the customer one, she called me out, I ended up refunding her and gave her the item then pulled my others,  long story short. A list of brand No No's without a sales receipt, or authenticity proof would be great! I know the fine print ones like human organs, and elicit drugs. I get it, but I don't think I've ever seen a brand specific list ever? Especially for sellers, selling a wide variety of products, with some items or brands maybe being strange or unfamiliar to them,for instance? Thanks for the great question,  I'm going to need to follow up this, and see what comes of it. Was all your item specifics covered? Like UPC or MPN? Just curious really? This actually raises a question about manufacturers re-called items list should also be available for sellers, I think. That would be good to.

Replicas or counterfeits cannot be sold on eBay regardless of disclaimers.

As far as I know replicas and counterfeits cannot be sold anywhere legally.   This doesn't stop the sidewalk and flea market vendors, but honest vendors stay away from them. Copies and replicas are illegal unless authorized, and authorize copies are few and far between. (and problematic on eBay regardless)

The VeRO program, referred to above, is a way for companies to protect their copyright and trademarks against infringement such as fakes, copies, replicas, counterfeits, "inspired by" etc.  

 

But it does not give them the right to prohibit sales and resales of genuine items.  Unfortunately, eBay favors the VeRO members when they make a complaint, so sometimes even genuine items are pulled. But it's because the VeRO member said the item was a violation, not just because it's that brand.

 

Thus, even if Red Ryder or the company that holds that trademark is on the VeRO list, that doesn't mean you can't sell Red Ryder branded products. It means that the VeRO member told eBay that particular listing was a violation; perhaps they never actually made the item in question.

The complains should be shared with the accused Seller.  

 

If Red Ryder made an assertion, fine, but they shouldn't get to do it secretly.

Did you mean radio flyer because red ryder is that bb gun from "A Christmas Story".  I don't see any kind of "Red Ryder" wagon on internet.  That could be the problem

Per eBay’s Vero policy for right’s holders:

 

Reportable listings include

  • Items that infringe on your intellectual property.
  • Counterfeit or replica items.
  • Unauthorized use of copyrighted content in a listing or product page

Ineligible reasons to report a listing

  • Wanting to control where a product is resold by trying to enforce contracts or distribution of goods to authorized sellers (selective distribution).
  • Not allowing the sale if items are below a controlled price point (minimum advertised pricing or MAP).
  • Any terms a brand puts into their contracts that controls the way items are resold (contractual issues).
  • Government-controlled items that are illegal to sell (regulatory compliance issues).

I agree that more transparency regarding the subject would be great, but from what I understand of it. The product does not need to be in violating or infringing any property rights to necessarily be used to pull an ad placement. The VeRo program seems to be in place as a precautionary measure to protect the intended products, just possibly misused or understood when used at times depending on the product, discrepancies, and the individual using it, I guess and can cause even a seemingly fine ad placement to be pulled. If ever in doubt, check! But.......... where? Or even easier, do not post it. Especially if being pulled already once. These statements are in reference to the comment above and are solely based on my opinion from previous statements above. and not researched facts. LOL!  Just putting that out there. But yeah, a seller link or something to use as a seller help guide would be great.
