I have a problem.

So I am selling digital codes and I accidentally sent a previously sold code to someone and they notified me of the error.

"The usage level has exceeded the maximum installations allowed. there is a problem with your license key and we are unable to activate your license. 
Please select one of the following actions: 
Deactivate other devices. 
Unless you refund my money within 24 hours I will follow charges against you immediately."

 

I responded with an apology explaining how I sent him an already sent key, then proceded to give him a brand new one along with another one just to be nice. 

 

He then responded saying I was committing fraud and is looking to take legal action or something. He is also threatening to take the money paid for the product after I have sent two more codes that weren't used.

"the license key is already used by you or someone else, you are selling an item that does not belong to you anymore, this is an absolute electronic digital fraud. you need to get your act strait. i will pursue this to the end, i will make sure that people like you be stopped. you will refund my money no matter how small is the amount."

 

I don't know what to do.

I've done some research and it seems eBay allows the sale of digital codes as long as you own them.

I'm afraid your research was incomplete, because you have not understood the policy correctly. The Digitally Delivered Goods policy says you can list digital items on eBay as long as you own the intellectual property, it doesn't say that you can sell them on eBay. You can't.

  1. You don't own the intellectual property for Malwarebytes software, and you aren't authorized to  sell it.

  2. Anything that is listed in Classified Ad format is only being advertised on eBay, it isn't being sold on eBay. That's because eBay doesn't want to risk being involved in these transactions, because they are rarely legitimate.

  3. There are no subcategories in the Everything Else > Information Products category that are appropriate for digital software codes, because they aren't legal to sell under the terms of the website that distributes them.

Well, having read all the other comments, if you have legal license to sell the codes, if the buyer attempts to take "legal action" the buyer is asking for a world of hurt. Assuming said rights, you have provided them with a unused code to replace the incorrect code sent. You have completed your obligation in the transaction. You do nothing else and deal with the buyer if the issue is escalated by the buyer.
Now, if you do not have legal standing to sell the codes...you may have some issues to content with.

All my opinion and assuming you are allowed by eBay policy to sell this product on eBay.

Items that can be or are delivered digitally can't be sold on eBay. They can only be listed in the Classified Ad format (which are sold off-eBay), if there is an appropriate category in Everything else > Information products.
