False Counterfeit claims

This is a community discussion forum for buyers/sellers on Ebay, not Ebay, Inc.  If you need help, go to the top of your page and click "help and contact"  or try Facebook for business:

If something on your site was deemed unauthentic or counterfeit, my suggestion is NOT to relist it.  You are under Ebays radar and relisting it could jeopardize your account, permanently.  You're selling lots of Apple products in multiples.  That's going to raise another red flag.  Be careful & Don't relist.

Best to contact eBay business through Facebook. No eBay employee will reach out to you.

It's almost never that anyone who works for eBay shows up on these Boards.

The Boards are generally composed of fellow buyers and sellers who volunteer their time here to help others.

And, regardless of whom you ask for help, you will probably need to offer more details of your issue, so why not start by returning here and doing that?

Depends on who is claiming an item is counterfeit and neither situation has a good outcome.  If Ebay is claiming an item is counterfeit then you have no choice other than to not relist the item.  You can contact Ebay for business on Facebook for an appeal but generally those appeals are denied.  If a buyer is claiming an item is counterfeit then you have no choice other than to accept a return.

I vote they were counterfeit based on the fact you think you can get eBay to contact you ASAP from posting here.

P.S.  Counterfeit claims are not made by eBay rather the owner of the copyright or trademarked goods.

From reading here many of the 'notices' that sellers receive, it can be either an eBay issue or a VERO complaint.  With a true Vero takedown, the message is quite clear, however, be the complaint true or not.  Some brand holders simply don't want their products sold here.

Did your buyer claim the Apple AirBuds were counterfeit?

If any buyer claims whatever you sold is counterfeit it's best you accept the return request and provide a return label and refund when the item is returned. To ask eBay to step in or for help will result in the buyer getting a refund and being told they do not have to return the item, and you get a defect for having a case unresolved by the seller.

No, eBay said that I have not followed their counterfeit item policy, although having sold these same authentic open-box AirPods on eBay before. I have never received any complaints from customers on authenticity of the AirPods. This time I decided to create a singular post with variations since I have more than one model available. (Just trying to be professional really, I am new to eBay). It was on my store for half a day and I woke up to this.

The ONLY way you will be able to sell them here is to involve Apple. You will have to prove to Apple they're not counterfeit and you purchased them from an authorized Apple distributor, and if you satisfied Apple they're  authentic they will have to fax a letter to eBay saying they're not counterfeit and you may sell them here. Then you need a message from eBay stating you can relist them. Slim chance of this happening but it's the only way to be able to list them.

For what it's worth, I was once Vero'd by Trends Intl on some perfectly legitimate brand-new posters I was selling, both on Ebay and in my brick & mortar curio shop.

I was feeling particularly salty that day so I grabbed my email and wrote the most politely vitriolic legalistic epistle I could cook up, to the Trends Intl email that was in the Vero notice, telling them in no uncertain terms that the company had no right to interfere in the sale of a perfectly legitimate product lawfully acquired, that if they continued with their unlawful interference the sale of their product by me would end not just on Ebay but in my physical store and also in the comic convention I was running at the time, and that I would do my best to spread the good word through the other retailers I knew.

And would you believe it, they caved.  Sent me an email with an apology.  Said they had decided that their takedown was made in error.  No lie.

But since I had only been selling 3 posters on Ebay at the time, I just took them all down anyway.   The prices kind of sucked anyhow. 😉

I printed the email and put it in a nice frame.

I think eBay takes down the obvious stuff on their own accord to lessen the issue for VERO involvement.  Some of the counterfeit goods are so blatantly fake it's a joke.  Especially designer type goods drop shipped from Asia listed in multiple quantities.
