False Counterfeit Reports

Here's a whole new issue that is just ripe for a class action lawsuit. I have a buyer I have banned from bidding on my items systematically reporting my items as counterfeit and eBay just blindly pulls my ads based on this persons words even though they have no basis. Who even decides these cases? With this procedure I could probably just close out about 300 eBay items a day. I contacted customer service and was told I would have to have items appraised, hey we are talking about $200. items. If I was going to counterfeit something it would be for a higher value than that. So why would I have to prove something was authentic if the person reporting the items does not need any proof? I mean they have pulled ads that have the actual manufacturers markings on them. So if somebody **bleep** you off just start reporting that all their items are counterfeit. You don't need any real proof or reason

We need more information.

 

1) Are these being done through the VERO system, or is it just eBay taking them down ?

 

2) How do you know these take downs were the direct result of a specific buyer making a report?

 

3) What specifically are the items that are being taken down?

 

4) Did any of those listings use the word Tele, Strat, Telecaster or Stratocaster anywhere in the listing (title, description, item specifics) for a part that was not manufactured by Fender? Did you have any generic guitars or guitar necks that had a headstock shape that was similar to one of the Fender headstocks?

Actually people counterfeit items as cheap as $1 so the statement of "If I was going to counterfeit something it would be for a higher value" insinuates guilt (by deflecting the blame), not saying you're a counterfeiter, but perhaps rethink that approach.

 

That being said, it is very easy to have seller's items pulled...

Tell you from my experience, what has helped me is to not be the cheapest...

Raise prices, when I price items on the high side I have far fewer problems, been my experience.

Seems it's the lowballers who don't like competition.

Since you have no proof that anyone turned in anything; there is no grounds for a class action lawsuit.

 

VERO could have also had your items pulled (google VERO on Ebay if you don't know what that is)

Oh the proof is out there, it is just not revealed who your accusers even are. I've been selling the same items for 15 years with 100% positive feedback and have only had this problem the last two nights at 5:00am

This forum is too much like social media, lots of opinions and no answers. If your ads start getting taken down under false pretense I think you would probably not be too happy. Plus I also notice most of the comments are coming from people who currently have no items for sale on eBay.

Yes, they’re called “posting IDs”. You have no way of knowing what or how much a person sells or buys.

 

Given the minimal info you’ve posted, what were you expecting besides opinions?

But you don't own "Squier," and Fender does, and they're an eBay VeRO member (and a pretty fierce one, at that) so that could be the problem.

 

As others have said, it's hard to say what the situation is until you give us more info about the take-downs.

 

And, just as an aside, your Terms of Sale are unenforceable because they are not in accord with eBay's policy on returns and refunds.

Many of those comments from "people who currently have no items for sale on eBay" are coming from eBayers who have multiple IDs, maybe one for selling, one for buying and one for posting here.

Also those of us who are exclusively buyers or who were selling but have stopped are allowed to post replies here.
