False Counterfeit Reports

Here's a whole new issue that is just ripe for a class action lawsuit. I have a buyer I have banned from bidding on my items systematically reporting my items as counterfeit and eBay just blindly pulls my ads based on this persons words even though they have no basis. Who even decides these cases? With this procedure I could probably just close out about 300 eBay items a day. I contacted customer service and was told I would have to have items appraised, hey we are talking about $200. items. If I was going to counterfeit something it would be for a higher value than that. So why would I have to prove something was authentic if the person reporting the items does not need any proof? I mean they have pulled ads that have the actual manufacturers markings on them. So if somebody **bleep** you off just start reporting that all their items are counterfeit. You don't need any real proof or reason

eBay employees must identify themselves as such or face 'enforcement' up to being fired.  So I doubt the boards are "full" of employees.

 

And a lot of what people call "cheerleaders" are just sellers who figured out how to make it work for them.  And nothing is as annoying as having someone tell you it's easy to do something you are having a very hard time doing.  It's just not something you want to hear - so the name-calling begins.

 

I'm not exactly what would be termed a 'cheerleader' -- I'm basically too cynical for that, and having as much experience in IT as I do, I sort of enjoy ripping down the curtain and showing folks that it's not really magic, it's just flaky computer programming, myopic design, and sloppy installation.  True - it's not all bad... but when it is, it's major.  And to have the venue continually deny things are happening when we all can see they are... that's just stupid.

 

eBay does have it's share of scammers - but so does Amazon, and so do B&M retailers.  It's a fact of retail that the retailer has to keep the buyer coming back until they finally cost the retailer more in lost profits & expenses than they make up in true purchases.  If a venue/store makes you jump thru a dozen background checks, id checks, blood-type checks, DNA checks, and facial recognition checks.... you're simply more likely to go to the store next door that has the same or very similar products without all the hassle.  And while it might be "cool" to be able to say that you are allowed to purchase at that terribly AR store, it probably won't take you long to realize that someone has to pay for all those checks.... and the only one bringing money into the store is you.  Ding ding ding ding ding - give that person a prize!

 

It bites and we all wish it would stop, but the simple fact is that a few people have been stealing from everyone else since the beginning of anything.  The reasons why are as numerous as the stars in the sky... but the simple fact is that if you have something someone else wants, and that someone has lower moral standards than you, chances are they are going to try to find a way to get it without compensating you.

 

Or as one mother in Memphis put it when her son was arrested for multiple burglaries: "You all have insurance, you'll get all your stuff back.  My son has to steal cuz he's got no money!"  I guess that means if we all quit our jobs, go broke, we should be allowed to steal as well?  Not sure that's a good long-term plan for the country as a whole.....

A class action suit requires a legal firm with the moxie and funding to take on eBay and get sufficient documentation from the herd of cats called eBay Sellers to prove to a judge that the case qualifies for class action status.  And that's all done BEFORE any serious discovery or court time....

 

Now if someone could prove that using eBay give you cancer... there are a dozen firms that specialize in that type of class-action suit.  Just watch enough very late night TV and you'll catch most of their ads..... 🙂

And the legal firm has to be willing to try to get around the fact that the eBay User Agreement includes a provision that the user will not bring or participate in a class action lawsuit against eBay:  Section 18, Legal Disputes, B., Agreement to Arbitrate, 1.  Prohibition of Class and Representative Actions and Non-Individualized Relief.

Thanks, I have a check from eBay on the wall of my shop for payment on a class action suit. The amount of the check is one cent.

REALLY?  When was this suit?  What was it about?  Details, please!  Post a picture of the check to prove, once and for all, that such suits are not only possible to bring but possible to win.  Please?

 

Or is that from the 2010 suit against eBay Motors?

I have nothing to prove it, but it has been posted many times that listings would need to be reported by more than one complaint source.  Needs to be more than than just a single malicious buyer/competitor trying to do you in.

 

It isn't just a one and done thing.  Would be complete havoc if allowed.

 

And yes, this ID shows no sales.  Don't need anyone to Scooby-Doo my listings to report that I spelled a word wrong in one of them after I post here.

To add...................   Also I stopped buying/selling on the same ID when I realized I could not leave honest feedback for a seller without fear of reprisal.

Getting a judge to 'sign off' on class action status overrules eBay's Terms Of Service and User Agreement.  But the firm has to find enough instances, over enough time, with enough attempts by the afflicted to seek relief from eBay, before a judge would even consider reviewing.

 

My wife just got a class-action claim form for a suit brought against a large national bank for it's misbehavior in relation to auto loans and early payoffs.  She had such a loan and 'paid it off' when the dealership rolled the balance over to her MKZ.  Given the condition of the vehicle traded in (our now-ex daughter-in-law had little respect for the property of others), it was a good trade for a beautiful new vehicle that she (my wife) very much deserved.  7yrs later and it's still a wonderful ride... when I'm allowed to drive.  I'm not a good passenger and I worry about my wife's depth perception.... 🙂

 

A class-action suit could be brought, but there are definitely steep hurdles to be passed to even get it started.

I have no idea why my filters for the LG fridge I bought and paid for was pulled I had the original box and paperwork I got when I bought them on Amazon I used one the LG refrigerator broke down and I figured I would get my money back for the other two but oh well there counterfeit seam's a little comical to me and nit picking. But if they are as bad as my fridge was I don't want to sale them anyway there's your plug LG

Yup. I tucked a dude off on FB and am pretty sure he is the one that reported my stuff. And idk how to find out who he is on eBay via his actual name. Can anybody tell me how to do that?
