Just had a horrible experience selling. Buyer demanded item shipped immediately. A month later opened a dispute. I responded to the buyer but didn't see any options to refute the dispute. Now I am out the sold product and $40 + fees. I really don't see any reason to use ebay anymore, I feel its completely jumped the shark. Has anybody else had a similar experience? Just not worth it based on cost and effort. Ebay favors scammers.

If by "dispute", you mean the buyer opened an item not received case, you should be able to just upload the tracking # to the case.

So you are saying this buyer went straight to PP or his CC first without starting out by an INR case with eBay?

Maybe eBay does not require you to respond.
Did you miss the email eBay sent you ?
I have couple of disputes - "Buyer did not recognize this transaction", INR disputes, eBay sent me emails saying eBay will handle them.
I guess your dispute should be one of those that eBay wil fight for you.
And I won every cases above.

Based on the response to other posters this does in fact appear to be a chargeback and the buyer went directly to their CC company and filed the claim. EBay does provide some seller protection against chargebacks and in certain situations handles the chargeback internally although they generally notify the seller that they have, or are, doing so. Check your messages in seller hub to see if by chance you have a notification from eBay regarding the chargeback and if they are handling it internally. Are you sure you are out the money for the sale. Did eBay send you notification that they had refunded the buyer and that the funds came out of your account? It is possible, depending on the situation, that eBay refunded the buyer out of their own funds (see policy link).
While it may not ease your view any as a few other responders mentioned you can take the transaction losses (fees, actual shipping and what you paid for the item) off of your taxes since eBay will not show the refund on your 1099, that only shows the gross amount of the dollars processed.

If it's a CC chargeback, eBay didn't side with the buyer. They complied with the CC issuer's demands.

No fighting needs to be done. If the seller has tracking proving delivery, all he needs to is upload that tracking # into the case if the buyer opens one.

If people would just offer free returns, you can deduct 50% when necessary and eBay will foot the bill for the rest and it won’t count against you. And you’ll never get negative feedback that can’t be removed

What was the reason the buyer used for the chargeback? I believe you stated you never responded to the chargeback is that correct? Is the reason they filed the chargeback one of those that is covered under the eBay policy for seller protection's for chargebacks?

I don't think that's quite how it works, not unless eBay is refunding the half that you keep to the buyer. I looked awhile back and couldn't find anything specific about that... However if they are then they are reimbursing primarily scammers while sellers get taken often... Unfortunately...
Also be prepared to wait a LONG time for the half your keeping to be released to you (maybe amount dependant). I did half off a return for a laptop sent back for false reasons and they threw it in the box I shipped it in, with none of the multi layers of different sizes bubble wrap and none of the 8 standing Styrofoam edging pieces. She did however drop a single ripped edge of bubble wrap in the box and return it completely covered in food, mainly jelly. It wasn't a touch screen but she must of tried using it as one with jelly all over her fingers then repeatedly opening and closing it stopping only to dip her hands in more jelly. To seal the deal she "ran" the entire charger cords (it's a Mac, about a 10-12ft cord in this case) in her jelly filly hands from charger to plug. At least I hope it was jelly. Anyways, I digress, I deducted 50% from the return, she had stopped responding me when I told her that the Mac wasn't missing parts of it's OS but that I could see she was trying to visit multiple websites , having never connected to the wifi. I noted the jelly was very a very classy touch and send her
pics of the now flat ends (that were curved before on a solid aluminum piece body) and noted I understand you forgot the ALL the packing material that got it arrived to you in like new condition. Perhaps you though it would safely to me without it so here are the pictures of that end result.
Anyways, it took almost 5 weeks to get my 50% released to me, if she can contest that I wasn't notified. If eBay doesn't get involved in he said she said there's no reason they would of been reviewing the case. I noted with the deduction everything mentioned above plus the fact in her feedback she had prior complaints for returning items "slopped" in food.

I'll give you the accurate answer that you're not going to want to hear. You might have some kind of recourse here. But the amount of time and aggravation you're going to have to endure to see it through is not worth it. Just chalk it up to experience, dust yourself off, and move on with your life.

If it was Item not received and you did not upload your tracking information into the case, then you will lose.
If it was Item not as Described and you did not accept return, provide label to get the item back, the case times out and eBay automatically step's in and refunds the buyer without requiring the items return.
