SIX WEEKS AFTER PRIORITY MAIL TRACKING SHOWED ITEM WAS DELIVERED, THE BUYER WENT TO THEIR CREDIT CARD (PAYPAL TRANSACTION) TO CANCEL PAYMENT SAYING ITEM WASN'T RECEIVED. THEY DID'T GO THROUTH EBAY BUYER PROTECTION NOR DID THEY NOTIFY ME. DOES EBAY OR PAYPAL KNOW WHAT A CAN OF WORMS THEY'RE OPENING IF THEY ALLOW BUYERS TO DO THIS ?

Buyers are able to do that.
How do you think either site could prohibit a buyer from doing a CC charge back?
You need to provide tracking for the item shipped.
PP is supposed to have your back on this if you provide the tracking.

eBAY LETS THE SELLERS GET RIPPED OFF REGULARLY. EBAY DOES NOT CARE...THEY GET THEIR SLICE AND HOLD THE SELLERS MONEY UNTIL THEY DECIDE TO RELEASE IT, IF ANYTHING IS LEFT.

I PROVIDED THE TRACKING WHICH SHOWED THE ITEM WAS DELIVERED AUGUST 28th. paypal took my info but said the credit card makes the decusion not paypal. and the buyer is a customer of the credit card not me so they often side with the buyer

If you did everything correct, including tracking through Paypal, then you should contact Paypal. eBay has no control over chargebacks. I would contact the buyer via email or eBay messaging and let them know you will be contacting the following people:
#1. Postal Inspection Service as if they do not return your property they will have committed mail fraud/theft of mail. Let the buyer know they should be expecting a knock on the door in a week or so.
#2. Police both on your end and the city they live in to file a property theft report. Give them the address of their police department. Call the PD on their end and talk to someone about the theft just to obtain a name and rank to pass onto to the thief/buyer.
Give a date when you expect your property returned. Then state you will be following thru on the above items the following day. Set dates and times for your expectations. Keep them short and to the point. Let them know you will not be going away. Above all, follow through and let them know they should be contacted shortly.
I have had this happen to me on a couple of occasions and each time I received my property back. I was fortunate to have a small local PD who sent a certified letter to the thief documenting the transaction and requiring them to return it to me. Each time the buyer contacted me letting me know that they would be returning my property and that they could not believe I would have gone to the lengths that I did to get it back. One item was for $100. Frankly, I would have flown to their city and filed in court as a matter of principle. That's just my opinion. Good luck!

Ebay has no idea when a buyer files a chargeback through their card.
Paypal has NO CHOICE but to cooperate with the credit card chargeback. Their hands are tied.
If you have tracking info stating that the package was delivered, upload the tracking number and corresponding info into the Paypal case. Paypal will eat the loss with the CC company and pay the chargeback fee out of their pocket.

Correct. PayPal has good seller protection in these cases, as long as you uploaded tracking to the case in a timely manner.

I have had charge backs before. Never lost funds any of them. YMMV
Yes, it is up to the CC company, but that is why we pay PP that processing fee. Seller protection, as southern*sweet posted. PP covers it.
That is how it works is supposed to work.
Also, it all hinges on having sent it where it was supposed to go. (address provided at checkout)

eBay cannot prevent a buyer from doing a chargeback on a credit card.
PayPal cannot prevent a buyer from doing a chargeback on a credit card.
The credit card company is the only one with the authority over credit card chargebacks.

I had a somewhat similar situation; package was lost by USPS; buyer wanted a replacement instead of $$$ back.
Buyer received the replacement; verified with messages and USPS tracking but still filed a claim with their bank.
Despite all the proof I submitted to PAYPAL, the buyer won the case. Thus the buyer got $$$ back from PAYPAL (PP did not take my money) and the item.
Naturally I reported all to eBay.
Buyer was a 0 feedback, brand new user.
