Buyer asked for return with implausible reason

So I had 2 of them in stock and sold one before he made the purchase. Each stick is 2GB and he now demands a return saying that he thought the listing was for 2 sticks. I told him I cannot accept returns for that reason and he threatened to escalate the case to eBay saying I made him confused. 

 

Who will win this case?

Your photo shows two items.
Your item specifics say :Total Capacity
4 GB
You description doesn't say they only get 1.

Accept the return and apologize profusely to the buyer

Yes. But the listing says “2GB DDR3”, not “2x2GB”.

Well, that's what the listing shows, as well as saying 4GB in the item specifics as noted in the other post.

 

You owe your buyer a full refund.

Your listing was misleading. You mentioned nothing about it in your description. Accept the return.

Separate the two types of ram in to different listings and only show 1 item

Clear, accurate listings are for your protection so you don't run into issues like this.

 

Never show in the picture something that the buyer won't be getting.  Thus don't show two items when they will only get one.

 

And the old adage, describe as if there are no pictures, and picture as if there is no description.

 

You need to have a complete, thorough and accurate description as well.  ALL the information a buyer needs to make an informed buying decision should be in the listing.  

 

If  the listing is confusing, it will cost you when the SNAD case rolls in.

The listing was incorrect.  Buyer will win.  You might want to accept the return because if the buyer escalates, you will get a very serious case closed without seller resolution defect that can affect your selling.

Being that the item is SNAD, this comes under the MBG, which overrides your no returns policy.  "Get the item you ordered or your money back"  If you want the item back, you pay return shipping, and refund the buyer the purchase price and original shipping.

The other option is to shop around for a second identical stick of RAM to have shipped directly to him.  If you play your cards right, you could end up paying out considerably less this way than paying for a return label, and then paying a full refund on top of that and hoping you get back what you originally sent out.

If it works, sell it. If it works well, sell it for more. If it doesn't work, quadruple the price and sell it as an antique.
