Bait and switch

I sold my '08 Corvette Targa top that was never used by me.  The buyer negotiated a cheaper price.  I ship the item.  I'm told that it was damaged in delivery.  I ask for a pic of the damage.  The buyer claims it has a crack in it.  The pic shows the right lower corner.  I didn't see a crack in the pic o I asked that he return to item.  After a delay the top came back but it was smashed in the upper left corner.  This top was covered in animal fur.  It clearly was not the same top.  However, Ebay grant my dispute then reverse it.  Their policies protect the buyers not the sellers.  After doing a little research it appears that the buyer is a Corvette parts dealer.  I have been had.  Ebay is asking me to refund this guys money but I don't get my top back.  What a scam.

     I am going to assume the buyer filed a NAD claim with eBay. Sorry for your situation but unfortunately you are a new seller and the first item you listed and sold was a high dollar item and you are pretty much a target for the scammer community. Your listing also indicates local pickup and no shipping. Did you actually ship this item or did the buyer pick it up locally and return it locally or ship it back? If it was a local return I will have to defer to others on how exactly eBay handles claim resolution in those instances. 

     For a normal shipped and returned item if you do not refund the buyer and they ask eBay to step in eBay will unilaterally refund the buyer from your account or if the funds are on hold simply not send you the payout. If the buyer is refunded about your only course of action(s) would be to report the buyer to eBay and file reports with the FBI cyber crimes division and the buyers local police department. However, unless there is a pattern of reporting it is highly unlikely any action will be taken.

Sorry this happened to you.

In this type of case ebay will always find in favor of the buyer.

Fortunately it doesn't happen that often.

There is a saying amongst ebay sellers.

"Don't sell anything on ebay that you can't afford to lose."

FYI The term "bait and switch" is usually used for a seller who cheats buyer.

New seller. First item sold. eBay allows them to sell a high priced item and does not protect them when they get scammed. This is so wrong, wrong, wrong. I am pretty sure the seller is done with eBay and will never sell on or use eBay again. Bad experience for the seller.  eBay should protect new sellers by first not letting them sell anything costing more than $200 for their first ten items.

 

I keep saying, eBay needs an algorithm that targets scammers and bans them. We now have AI. Yes, stuff happens and not every claim is a scam, but if a buyer has five plus claims of empty box, damaged item, INAD and on and on, it is time for eBay to tell the buyer to shop elsewhere.

It would be a matter of small claims and would need to be filed in the buyers jurisdiction.  I doubt it would be worth it.  It would be nice if someone could sue Ebay for allowing a new seller to list an expensive item in a category well known for scams without any warning whatsoever.

Just a note - that is not what bait and switch means.

 

What you encountered was just plain old fraud.

 

Generally speaking, on eBay any buyer can steal any item from any seller at any time by filing a fraudulent dispute.
