That "Surprise ball" is a ocmmercially-produced item with a UPC and everything. It's no different than those mini-Lego packs where you could get any one of 20 different figures.
What IS definitely banned are "mystery boxes" that comprise random stuff assembled by the seller. There's a clearly stated policy, but still there are mystery boxes listed.

Anyone who would spend $140 not know exactly what they are buying are seeking a surprise. I've never been surprised but I've been disappointed.
The real value of this would be to have a list of those who have bought these things. Can you imagine what you could sell them? The Golden Gate bridge. Oh yeah, and timeshares in Afghanistan.

Just like the hatchimals last year that is why they are so popular.
As far as true mystery boxes, I came across one yesterday which is supposed to contain many pieces of jewelry. Reported and of course 24 hours later nothing was done.
