I am the Seller, in the process of appealing an Item Not Received Money Back Guarantee case. The basis of my appeal is that the buyer is NOT covered by the MBG because this was a Local Pickup Only listing and the buyer did not pick up the item or have someone else pick it up for them. It clearly states in eBay policy that such cases are not covered by the MBG. I called eBay this morning and filed an appeal because there is no direct option to appeal in writing from within my eBay account. So my question is, is filing an appeal by phone the only way to file an appeal?

The buyer asked to cancel because he didn't realize how far away he was and you refused to cancel. I don't understand why you wouldn't just cancel. Refund and move on...

Correct, there was no shipping but the seller REFUSED to cancel when asked. Hopefully Ebay catches on to this seller's shenanigans.
The only way to be protected from item not received case is to have a written signed receipt of item, or the q code on local pick up.
Its in the rules and this user did not get one of course.
eBay found correctly.

With all the shenaning going on in here the simple facts boil down to this:
The seller is in the right and the buyer is in the wrong but this is ebay.
so...
The seller will 100% lose and the buyer will 100% get their money back.
...and the REAL shenanigans were the friends we made along the way.

Seller won't lose. If Ebay does nothing then the seller keeps the bike and the buyer gets his money back.

I have successfully filed many small claim suits against large corporations including Fedex, UPS, and my local bank. Often, all I have needed to do is send a legal Demand Letter to the company's Registered Agent in my State, with a threat of legal action if my demands are not met within 30 days of delivery, to get a check in the mail to me.
Sounds like a pretty profitable racket. I bet a lot of those companies sent a check so they wouldn't have to hire a lawyer to deal with a frivolous claim. No wonder people despise lawyers and small claims court trolls.

Sure, sellers can deny if the buyer asks to cancel and file for non-payment if they prefer.
But just because they refuse to cancel the transaction doesn't mean the seller should get to keep the payment if the buyer made it clear there was no way they could pick up the item.
From the beginning, the seller could have refunded the buyer minus his fees instead of digging his heels and waiting till the buyer filed a dispute.

What is the seller losing? Bear in mind the buyer could have had a chargeback and the seller would lose an additional $20.
