So this is my story. a while back i sold something on ebay and was preparing to ship it out the next day when i get an email from ebay that my account has been permanently suspended with no room for appeal. when i contact ebay as to the reason for the suspension they say they cant tell me because then i might try to circumvent there resrictions. so than i ask them about the item i had sold the day before but had not yet shipped. i wanted to know if the suspension would affect my ability to get paid for the item once the buyer received it. "Not to worry" i was told, as long as the buyer receives his item u will most definitley receive ur money for the item
Ok so i go ahead and ship the item with a prepaid shipping label bought directly from ebay so i know that they have access to the tracking info.
A few days later i see on the tracking that the item has indeed been delivered. and the funds are in my account however i can not access the money yet as it is on hold until the 30 day window for returns runs out.
So here's where the trouble starts. Around a day later i get a message from ebay that the buyer has filed a claim that he has never received the item. and they have opened a case about this issue. A few minutes later i get another email from ebay that the case has been closed in the buyers favor due to a lack of proof that it has been delivered.
So of course i contacted ebay right away and explained to them that i had been tracking the package the entire time through ebay being that i had bought the shipping label directly from them. So they look into it and tell me that even though it is true that they have access to the tracking that clearly shows it was delivered, due to the fact that my account also happened to be suspeneded at the time they automatically close the case in the buyers favor and gave him back the money.
So at the beginning i was just fighting with them to get my money back but they kept on saying that because there are restrictions on my account they can not file an appeal.
So i decided to switch gears. and after fighting with many agents for i while i finally managed to get them to lift the suspension from my account.
So of course i immediately filed an appeal once, twice, three times, again again and again. and i still have yet to see my money. sometimes i received a response saying that i have been denied due to not providing tracking(which is obviously not true), sometimes the response has been that i have been denied due the the fact that my account is restricted(which is also not true) and sometimes i haven't received a response at all. This has been going on for months now.
Each time i bring up all these points to a rep. they always tell me that they have to send in another appeal and THIS time i will get a normal response but of course the results are always one of these three options.
So my question is where to go from here. Should i file a claim in a small claims court(it is under 1000 dollars) (and i have already threatened them with legal action). will i accomplish anything with that or is there some other option that i have missed?

You stated that you printed the label through ebay so by right, they should be able to see it. But when the buyer opened INR (item not received), did you respond to the case? Did you copy and paste the tracking number into the reply?
Even when you print the label through ebay, you MUST respond to the case and if you didn't respond, that could be the reason for your problem with getting your money.

Immediately after i got the original email notifying me of his claim, I I was about to respond when literally within 5 minutes, before i get a chance to respond, i get a second email that says that they closed the case in the buyers favor and there is nothing more to do other than contact the buyer. and an agent later told to me that even though they indeed had the tracking info they autoumatically closed the case in his favor due to the fact that my account happened to be suspended at the time (due to reasons that i still am not aware of).

When buyer/seller are suspended/removed, cases can be filed immediately (no waiting period) and decided almost instantly (no waiting period).

I understand why they closed the case at the time. what i dont understand is now that my account is clean why i cant appeall it

Just a slight clarification/correction . . .
According to a post by Tyler in a Weekly Chat last fall, if tracking was purchased through eBay, a seller should not have to re-enter the tracking number into a case.

Members should not have to reupload the tracking number, we already pull it from the transaction data (as long as it is from an integrated carrier and the label was purchased on eBay).
That said, you should always reply to a request within 3 business days, but uploading tracking is not a requirement as long as it meets the criteria above.

What do you mean you can't appeal it? You said in your first post:

So have you appealed it or haven't you? Or did you mean "Why haven't I won my appeal?"

This is exactly why Sellers are rightfully terrified of MP.
That they won't even tell you why you are banned is wrong.

Yes that is indeed what I meant. However it should be noted that each time I speak to an agent they agree that there is indeed no reason why I should not have won and they tell me that they will send in another appeal which THIS time will help. Also the past few appeals that I sent I have never received any response to and the agents tell me that because it is still pending.

i would like to add that i saw a website advertised called donotpay.com that claims to help u sue ebay. i was wondering if anyone has any info about this site please let me know
