Return not returned

How do I report a buyer that hasn’t returned a product they said was damaged? I’ve messaged them three times and no response and it’s been almost a month.

It isn’t a problem.  You don’t have to refund until your item is returned to you.

Ebay allows a buyer a very generous amount of time to return an item (I adamantly disagree with the time allowed but that is a subject for another discussion).

On your return details it should give you the date the buyer must ship the item back to you (providing you purchased the return label through eBay and not by another method).

Once the allotted time has elapsed without the buyer shipping the item eBay will automatically close the return in your favor (no refund will be issued to the buyer).

You can then go to the Resolution Center to make a report for the buyer abusing the returns policy.

I recommend you add this buyer  to your "blocked buyer" list to prevent the buyer from making another purchase from you and possibly creating more issues for you.

If they don't ship it back, the case will time out and close.

If you already refunded the buyer, the case is closed and you probably won't get the item back

I did right away as I am new to this and was trying to do the right thing. They said it was damaged and took pictures and everything. Haven’t heard a peep since.

You are not going hear anything from them. You closed the case by refunding prior to receiving item. If you accept returns, refunds are done once item is received. 

There are some times, when you need to make a decision to refund without receiving items, such as:

Cost of return shipping outweighs cost of item

Seller just flat out do not want to receive item or deal with re-selling

Damage item, what good will a damaged item do for you? unless you can repair and re-sell as well. 

I'm sure others will come in with some circumstance, but the main mantra is RETURN FOR REFUND.

My issue with that is eBay said if I don’t refund within three days I could get a negative report. It’s a damned if you do damned if you don’t situation then don’t you think?

I echo... Did you refund them?  If not no worries because eBay will close the case in your favor

Don't refund until your item is returned - unless you do not want your item returned.

If they don’t return by the date on the case, it will time itself out and they will not be refunded.

I think they said that, if you don't refund within three days AFTER RECEIVING THE RETURNED ITEM.
