Partial refund

As a buyer, I received an item that was awfully packaged in a paper bag and, naturally, was damaged in transit. The seller offered a partial refund without returning the item. I agreed, but the seller did not refund within 10+ days. When I asked about a refund, he replied "after I get my item back". Does he have the right to do this and what are my next steps?

Right now the status is: "The seller has initiated a partial refund to your original payment method. If you don’t receive your refund within 3 to 5 business days, you can ask us to step in and help." and no option to ask eBay "to step in".

Sounds like, "If you don’t receive your refund within 3 to 5 business days, you can ask us to step in and help." 

 

You won't see the option for eBay to step in until the allotted time has expired. 

 

This is contingent that you opened a return case for "Item Arrived Damaged" and you have a case open with eBay.

Open up an item NOT described case.   Get the item ready to ship back to the seller.  Follow the prompts. Ignore any emails from the seller.  If he does send the partial refund, then tell him too late.  He played games with you with the refund and now you are playing the game  I want my refund because the item was NOT as described."    It's sellers like that that give Ebay a bad name.

Make sure that you return the item ONLY if you get a return shipping label from the seller.  Do NOT pay for the label yourself.  Do NOT listen to the seller if they tell you to close the case and he will refund.  In fact, if he does,  REPORT him to ebay.   That is a violation.

I mean the refund process is kinda stuck 😐

no money, no return shipping label, no button to ask eBay to step in

only "The seller has initiated a partial refund to your original payment method" three weeks ago
