Manufacturer default

Hello,

I made a purchase of some new trainers to go walking in. After about 3-4months the soles started to fall apart. I contacted the ebay seller who said that they would need to send them back to the Manufactuer. THis happened and the manufacturer accepted there was a fault. The seller said that as the claim was made after ebays 3 month I was not able to get a refund. 

 

The seller was not able to replace the items as no longer in stock they have offered me store credit. But they do not have any shoes in my size that I want. A replacement has not been possible. I'm now wondering as this was a manufacturing fault what my rights are. I am now out of pocket, with no shoes and the ebay seller is no longer responding to my questions.

Due to ebay purchase history being older than 3 months it appears i'm unable to do anything within my account either.

eBay offers a 30 day money back guarantee. You're well past that time frame.

 

Did you send them back to the manufacturer or did the seller? You said the manufacturer confirmed a fault - did the manufacturer offer a comparable replacement?

 

The seller offered you a store credit which they were not obligated to do. Use the credit for yourself or a family member.

This is not on the seller. They were kind enough to give you a store credit. That is more than most would have done. You can go after the manufacturing company but i am sure that would cost more than the shoes. As the previous poster said use the credit for a family member or friend.

HI, many thanks for the response. The shoes where returned to the seller who then sent off to the manufacturer.  I would be happy for a store credit providing they had shoes in my size that were fit for what i need the shoes for. 

 

I now feel that as the store would have got a refund from the manufacturer so should I. 

 

Do you know if i can take this up with paypal to reverse the funds to the seller? I'm not sure if this is slightly unreasonable though.

Technically you can file a payment dispute since you returned the product - if you saved that tracking info - however the seller has already "made you whole" by offering a store credit and they can easily fight the dispute with that info. So you could lose the dispute and gain ill will with the seller.

 

You also don't know the seller got a refund from the mfr. They may have gotten a credit which is what they are extending to you plus the seller is losing out on multiple shipping costs (to the mfr and to you if you use the credit).

 

Does the seller have other shoes you like? Ask if they can get them in your size. If not, use the credit for family/friend.

 

Make sure you ask the seller how long the credit is valid since they don't currently have anything that suits your needs.

Please remember that most manufacturers do not honor warranty claims on items bought on eBay as most eBay sellers are not an authorized representative. They only honor those who buy direct from them. The item in question was damaged 3-4 month after receiving it, therefore seller, nor eBay can do anything about it.

Many thanks once again.

The seller is no longer responding to any further questions and I am now left without faulty shoes, credit or money. To me this doesn't seem right. 

 

I have no idea where to go from here?

 

I should at least get the shoes back.

The shoes are like yesterday's newspaper,  gone.

 

Would have been nice to have figured out what to buy with the store credit which is also by the wayside at this point it seems.

 

PayPal sounds like your only option at this point. Or your credit card if you paid via credit card thru PayPal.
