How to get refund

Hello ebay commnunity,

 

In early April I bought a figure for $800.
However, the one I received was a different figure, so I asked for a return and refund.
Then the seller called me a scam and refused to refund me.
Later it turned into a case and I lost.

 

According to ebay customer support, if the buyer uses such freight forwarding service, the seller cannot be held responsible for damage/lost of the item in transit.
This means that buyers like me are not covered by the terms of the eBay Money Back Guarantee Program.
Then ebay closed the case so that the seller could receive payment for this transaction.

 

$800 is a lot of money for me and I definitely want to get it back.
Please let me know if there is a better way to handle this situation.
No matter if it's free or paid.

Are you saying that freight forwarders do NOT open and inspect packages?  I always thought that they did just to make sure that the correct item was sent and that it's in the same condition as the listing stated. If the item is not opened and inspected, the seller can put anything inside a rock.  Also this could be a way to send drugs and other contraband out of the country.  That is why I was sure that the items are opened and inspected.

 

Anyway, there have been several posts here where a buyer used a freight forwarder and they got a different item.  One person got a cheap , used cell phone instead of a new one. Another one complained that they did not get their pricey shoes.   I say that the item was stolen at the freightforwarder.   The seller is NOT responsible for anything. I sell with another account and everything sent to a freightforwarder except one box.  The buyer claimed that I sent an empty 4 lb box to Brazil via a freightforwarder.   It's obvious that either the freight forwarder stole the item or the buyer was lying.

 

I feel sorry for folks that buy pricey items online and don't get them for whatever reason.

Since the item is still at the freight forwarder, and it has not been re-shipped @acplco29 

-- you did not lose eBay MBG coverage, and eBay made the wrong decision in closing your case.

You're covered because your item is still there, where it was originally delivered. Leave a private message here for eBay on Facebook (or open an account just to contact eBay) and tell eBay that

 

1. it is still in US,

2. the received item is not as described, and

3. you need a prepaid return label for the US address to return it for a refund.

I'm not sure about the # 3 return label, what should I do?
I'd be very happy if this worked.


#3 is just you being honest, that you are prepared to return the not-as-described item for your refund, no matter if it's free or paid, as you wrote @acplco29 in your original post:

But be sure to include this eBay policy screenshot

to remind eBay of their own policy, and emphasize that it has not been re-shipped.

Hi,

 

In the end, I was not covered by ebay MBG.
It would be impossible to overturn the decision of the case without going to court.
However, I should have received a refund directly from the Scam seller, which continues the request.
It is a problem that ebay neglects this seller.

In the end, [after contacting eBay on Facebook] I was not covered by ebay MBG.
I should have received a refund directly from the Scam seller, which continues the request. 


eBay would have to pay you $800 out of their own pocket if they relent that you're still covered by eBay MBG because your item was never reshipped and is still at the freight fowarder, ready to be returned. So eBay would rather fall back on their incorrect decision, than admit their misunderstanding and error.

 

1. If you paid with PayPal, file a dispute here within 180 days for SIGNIFICANTLY NOT AS DESCRIBED. Add that message refusing to refund. Don't talk to the seller, or respond. Then when you're told to return the item, pay for return shipping WITH TRACKING, to get your refund.

 

2. Otherwise, contact your card issuer to file a DEFECTIVE OR NOT AS DESCRIBED chargeback. Explain @acplco29 that you can return the item

-- from your freight forwarder at a US address

-- to the seller at a US address, to get your refund.

Yeah, don't use a freight forwarder.

 

You are at the end of options on ebay.
