How to get refund

Hello ebay commnunity,

 

In early April I bought a figure for $800.
However, the one I received was a different figure, so I asked for a return and refund.
Then the seller called me a scam and refused to refund me.
Later it turned into a case and I lost.

 

According to ebay customer support, if the buyer uses such freight forwarding service, the seller cannot be held responsible for damage/lost of the item in transit.
This means that buyers like me are not covered by the terms of the eBay Money Back Guarantee Program.
Then ebay closed the case so that the seller could receive payment for this transaction.

 

$800 is a lot of money for me and I definitely want to get it back.
Please let me know if there is a better way to handle this situation.
No matter if it's free or paid.

Since the item is still at the freight forwarder, and it has not been re-shipped @acplco29 

-- you did not lose eBay MBG coverage, and eBay made the wrong decision in closing your case.

You're covered because your item is still there, where it was originally delivered. Leave a private message here for eBay on Facebook (or open an account just to contact eBay) and tell eBay that

 

1. it is still in US,

2. the received item is not as described, and

3. you need a prepaid return label for the US address to return it for a refund.

Sucks but true. Your MBG rights are null and void when you use a freight forwarder. I was wondering how the heck you lost the case until you said that bit.

 

I assume a charge back from your financial institution is still a viable option? That I don't believe has any such contingencies like the MBG...

I couldn't get a refund because I didn't meet my VISA credit card requirements.
The seller is continuing eBay selling as usual, which is very strange and infuriating.
I have sent messages many times but the seller has not replied.

Are you saying you don't meet the requirements for a chargeback?

 

Honestly, don't expect a refund from the seller. They already "won'...

You used a freight forwarder.  They are supposed to receive the item and check it out before they ship to you. If it was the wrong item sent, they should have informed you immediately .  In your case, I say that the freight forwarder stole your item.  You have a problem with them. Take it up with them. Somebody there stole your item.

Sorry, if you already tried opening a case with your credit card, there's nothing else you can do, but maybe small claims court.

Don't know how that would work since you're in Japan.

I think the seller should be penalized in some way even if the refund is not possible.

Since the Freight Forwarder took picture of item and it is not the same item, is it possible since the item is still in the US that a Item Not as Described Claim can be made and the Freight Forwarder return the item when they receive the shipping label.

Ahh, so I didn't realize until right now that the MBG was voided the moment it was shipped to a frieght forwarder. I knew that when a buyer has an item forwarded to another address after delivery (such as using a freight forwarder) the MBG was voided. That part directly relates to re-shipment of an item... However, I did not know (until right now) the mere receipt/collection of an item by a 3rd party on behalf of the buyer voids the MBG. Learn something every day

I have always understood that once a item is received by a Freight Forwarder then a claim can not be made for a lost item and once item accepted by the Freight forwarder then a damaged item claim cannot be made.  However when item is received by buyer and it is not as described then a Not as Described Claim could be made.  The only problem is that the International Buyer must get the item back to the seller in the US.  But even with a not as described claim the time limit (30 days) could be up before the buyer even receives their item from the Freight Forwarder.

It appears there is a direct exclusion for "Item Does Not Match the Listing" (NAD) if the item is collected by a 3rd party on behalf of the buyer. So lost, damaged, and NAD seem to be excluded when collected by a 3rd party.

 

If you're saying the MBG for NAD cases is re-instated once the buyer receives it (after forwarding), that doesnt make sense to me. That would be a second violation/voiding.

 

It is voided upon re-shipment of the item or shipment to a secondary address after delivery to primary address (freight forwarder shipping it to buyer), that's a clear exclusion and better known I believe ... but the first exclusion (one I just learned) listed in the chart for NAD says 3rd party collection is an exclusion too.

 

That sounds to me the collection/receipt by 3rd party forwarder violates and the shipment/forwarding violates. Sounds like EBay wrote the policy in such a way as to discourage the use of freight forwarders as it violates no matter who has possession, the forwarder or buyer, and that cases can't be made at any step post initial delivery when using freight forwarders.

 

I suppose an item not delivered to the freight forwarder in the first place (no delivery confirmation) would be a viable MBG claim as delivery was never completed and no 3rd party received or forwarded as they never had possession... 

 

Either way ... not sure how to square what I'm reading with what you've said. 

 

Long story short... i wont be using any freight forwarders 🤣 I have no need.

I am sure you are correct. 

 

Seems like a Freight Forwarder could be a risky business for the buyer.  Seller could put anything in package and not be held accountable for wrong item.  I have only done about 35 International sales in last two years and so far my packages have not been opened as I have asked the buyers.
