return/refund broken item

Hi! I bought a TV on ebay. The seller sent the TV a day after the delivery date so I asked for a refund. The item was delivered 7 days later. I collect it, didn't open (which I now regret) and returned it back to the seller. The seller said now that the item is broken and sent me pictures of it.

Is there anything I can do to solve this? I won't probably have the money back now...

You are in the UK......and I'm assuming you bought it there.....this is the US board.  I would ask on the UK board as rules may be different than here............
