So class action needed?

Anyone else having their Seller money being held for no reason? Since Ebay does not pay interest on money being with held for payment, I do believe this is grounds for a lawsuit.

It does not give eBay carte blanche. These agreements are thrown out by judges every day. Just like those NDA's that some conman thought was iron clad. They are not. It all depends on what factually occurred. Any lawyer worth their salt knows when you have a case and when you do not. So, it is on a case-by-case basis if that agreement has any teeth in it or not.

No, not me.

I find it quite idiotic for anyone to think that ebay is holding their money for "no reason".

There is a reason.  Ebay dosn't pick sellers at random and decide to hold their money.

 

You don't need our permission to see an attorney about a class action lawsuit,

but do you realize you have agreed not to take any legal action against ebay by using their site?

Maybe you would be more comfortable with an attorney explaining that to you instead of one of us idiots.

I think this is about the fourth or fifth class action suit against eBay that sounds like it might apply to me.  

People think they can get rich from class action suits.  But unless you're in a class action suit against a huge corporation that defrauded thousands of large stockholders, including you, no, you're not going to get more than a couple dollars.   And class action lawsuits take a very, very, very, v-e-r-y long time.   (The only ones getting rich are the attorneys.)  

A couple dollars is about enough for me to buy about a half a gallon of gasoline today. 

 

Yawn.

Has to be about the 10th or 12th post about filing one this month.  So far, no filings, that I can find?

Both eBay/Managed Payments and Paypal have said that they keep Held funds in a non-interest bearing account.

This may actually be a legal requirement, but I'm not a lawyer. I don't even watch Law and Order.

 

FWIW - interest on savings accounts is low these days.  I don't think it has been this low since I was a bank teller back in the late 1960s.

Up to $1000 this bank (which also is a US bank,btw) pays 0.01% annually. ($10 a year)

On $1,000,000 or more it pays 0.5% annually.

 

How much interest does eBay "owe" you for a 30 day Hold?

I think what some people may be disturbed about is that ebay would pay them - as usual - in an account credit (no cash changing hands) while they would be getting hard coin from the bank.  I wonder what the interest would be for however many millions or billions of dollars that pass through ebay in a year?

Not saying 'NO' doesn't mean 'YES'.

The foolishness of one's actions or words is determined by the number of witnesses.

Perhaps if Brains were described as an APP, many people would use them more often.

And for those who don't want to click links, here's the specific portion, my red bold-face on the specific class action prohibition. Any claims must be as an individual or you must go through arbitration.

Here is the reason your money is held.

Your feedback shows you stopped selling more than a year ago and in the last six months you have 9 feedbacks for selling.  Because there was no activity for  selling eBay treats you like a new seller. Until you get 25 feedbacks for selling they can hold your payments until tracking shows delivered. They can hold payments if you sell in a high risk category.  Coins would be  high risk.

I agree that a class action might be need solely for business practices. I had an issue with a return request a buyer made, which was bogus. I wanted to fight the request and contacted Ebay, I was told I needed to wait 3 days then I could ask Ebay to step in and help. which turned out to be a contradiction in terms as when I clicked the link to ask Ebay for help it actually lost me the case, and the decision was in favor of the buyer solely because I clicked the link to ask Ebay to step in and help with an investigation again contradiction in terms as there was no investigation done because I clicked the link to aske Ebay to step in and help. Since then, I have in essence been harassed by Ebay having my account suspended 2 times, had my selling privileges restricted 6 or 7 times, and have had my bank account debited for over $1000 which I don't have in the account that I have been charged $29 so far 6 times for insufficient funds.
